HOUSTON -- Barring last-minute intervention by the U.S. Supreme Court, Timothy Wayne Adams, 42, is scheduled to be executed Tuesday night in Huntsville.

Adams killed his 19-month-old son, Timothy Jr., in Houston in 2002 in a custody dispute with his estranged wife. Adams shot the toddler twice in the chest. At his trial, prosecutors called him a man who snapped because he was afraid of losing the child and killed his son because he wanted to punish his wife. 

That woman, Emma Adams, is one of the family members scheduled to witness the execution at the Walls Unit in Huntsville. Adams' parents, who in the final weeks leading up to the scheduled execution made emotional pleas for their son's life to be spared, are also scheduled to be among the group of witnesses. Their appeal to the Texas Board of Pardons and Paroles was denied unanimously last Friday.

Columbus and Wilma Adams pleaded for clemency, asking that their son's death sentence be commuted to life in prison without parole. They told 11 News they still suffer from the loss of their grandson and don't want to lose their son forever, too. Adams' parents visited him on death row in Livingston nearly every week.

Murder of a person under the age of 6 is a capital offense in Texas that qualifies for the death penalty. However, in the final months leading up to the execution date, as many as three jurors who sentenced Adams to death joined with his parents in asking for clemency.

Adams' execution by lethal injection is scheduled nearly 9 years to the day since his son's murder. Timothy Adams Jr. died February 20, 2002.

There are currently 305 men and 10 women on Texas Death Row. Three more inmates are scheduled for execution between now and July.

HUNTSVILLE, Texas -- The U.S. Supreme Court has refused to stop the execution of a Houston man scheduled to die for the 2002 fatal shooting of his 19-month-old son after an hours-long standoff with a police tactical squad.

Justices Tuesday rejected arguments from Timothy Wayne Adams' attorneys. The attorney contended that a 2007 Texas court ruling reducing a death sentence to life in prison for a mother convicted of killing her newborn son should apply to him as well because the cases are similar.

The court's denial came about five minutes before Adams' scheduled execution.

The 42-year-old Adams is set for lethal injection in Huntsville for the death of his son, Timothy Jr., who was shot twice at close range by his father after the police standoff at his family's apartment.

I don't think you should support the death penalty to seek revenge. I don't think that's right. I think the reason to support the death penalty is because it saves other people's lives.

The execution took place about 35 minutes after the U.S. Supreme Court rejected a final appeal from Adams.

Adams, 42, declined to make a final statement, shaking his head no when asked if he had any final words.

He let out a series of final gasps as the lethal injection took effect. Ten minutes later, at 6:31 p.m. CST, he was pronounced dead.

Adams was the second Texas prisoner put to death this year in the nation's busiest death penalty state.

Prosecutors said the toddler's slaying was intended as retaliation by Adams against his wife because she was leaving him.

Defense attorneys argued the killing was an aberration in an otherwise law-abiding life.

Adams' family had asked that his sentence be commuted to life in prison without parole. His parents, brother and sister witnessed the execution.

I've had a heavy heart all day with things in my life today but this make me feel some better, knowing he will never hurt another child. I hope he made peace with God before going, if not the weather in Texas probably seems mild by comparison.
