The Ohio Supreme Court has set an October execution date for a condemned killer who beat his girlfriend with a pipe, threw her in a river and stole $400 from her bank account.

The court ruled Friday to schedule the execution of 48-year-old Michael Benge of Butler County for Oct. 6.

Benge was sentenced to death for the 1993 killing of his girlfriend, Judith Gabbard, on the west side of the Miami River in Hamilton in southwest Ohio.

Benge beat Gabbard with a metal pipe several times during an argument, threw her body in the river, then used Gabbard's ATM card to withdraw $400 from her bank account.

The court has scheduled one execution per month through October, putting Ohio on pace to execute a record number of inmates this year.

Looks like Ohio could get all 12 possible executions this year... Statistically speaking, we could well see the two-drug protocol used for the first time either this year or next...

Ohio is really on the ball right now when it comes to executions.  They set meaningful dates and have the most efficient lethal injection procedure in the nation.  I just wish they would execute more than 1 a month.

I'm going to nickname Ohio "Little Texas".  :)  8)

What's more, the court has stated that the above limit is to apply "in general", which would seem to allow some wiggle room for the carrying out of executions not in keeping with the three-week limit.

You're right, but the Court currently seems to be setting one execution per month, usually around the middle of each month.  There is, of course, nothing stopping them from fitting two executions in one calendar month, though they haven't yet done so.

The rule might also only be applied to inmates who are being represented by the Ohio Defender Service.  Last year, John Fautenberry and Marvallous Keene, both ODS clients, were executed only seven days apart.  The ODS claimed that such close scheduling did not give them time to adequately defend both clients in clemency petitions and court appeals.  If an inmate were being represented privately, the ODS argument would no longer apply.
