Hopefully they will get this third evaluation over quickly and he's found to be competant enough to stand trial (and hopefully represent himself *snicker*)

NAPLES — Accused killer Mesac Damas again pushed for permission to represent himself in his death penalty case, making the request during a brief hearing Tuesday.

The hearing, set last week by Collier Circuit Judge Franklin Baker, concerned the appointment of a third psychiatrist to evaluate Damas, Dr. Frederick Schaerf. Defense attorneys e-mailed Baker after his office made plans to forward Schaerf the results of two prior evaluations of Damas, a move opposed by Damas' attorneys.

"I believe he must perform an individual evaluation," Deputy Public Defender Kathleen Fitzgerald told Baker.

Baker agreed to allow both sides to decide the extent of materials received by Schaerf, so long as their decision was made today. The judge then told Damas he was aware of the defendant's standing request to represent himself, but that he could make no decision today.

Damas appeared impatient with that answer, repeatedly saying he'd like to represent himself and invoking God as the only one who could judge the defendant.

"No disrespect, you know what I'm saying, but I'd appreciate it if next time the judge would address that," he told Baker.

Damas, 34, faces the death penalty on six counts of first-degree murder for the slayings of his five children and their mother, Damas' wife, Guerline Damas, 32, at their North Naples home in September 2009.

The case appears to be moving toward a hearing that would decide Damas' competency to stand trial. Two previous evaluations have reached different conclusions about the defendant's competence, setting the way for the third, and final, evaluation before a hearing.

Baker has repeatedly expressed concerns with delays in the case, today calling it akin to "jumping up and down and landing in the same spot without moving forward."

I hope they take that bastard down to his last pair of sh*t stained underwear.   With being on the 3rd mental evaluation I guess they are not getting what they want yet.  Either way, this guys going to 'get it' >:(

An April 8 hearing has been scheduled in Collier County for alleged family killer Mesac Damas.

Damas, 34, is charged with six counts of first-degree murder in the slaughter of his family, including his wife, Guerline Dieu Damas and their five young children in September 2009. He faces the death penalty if convicted.

At the hearing, the status of the case will be discussed.

The case has been at a standstill since January, when Circuit Judge Frank Baker ordered a third mental evaluation for Damas, who routinely makes outbursts in the courtroom, quoting scripture and proclaiming that God is his judge and lawyer.

His hearing last month was postponed because a report summarizing his third mental evaluation had not been received by attorneys.

A judge has set a May hearing to determine the competency of defendant Mesac Damas in his death penalty case.

Collier Circuit Judge Franklin Baker estimated a half day would be needed for the evidentiary hearing, which will feature the testimony of three psychiatrists who evaluated Damas, 34, and arguments from attorneys.

If Baker deems Damas incompetent to proceed, the defendant could be ordered to undergo specific treatment or he could be sent to a state facility for "competence restoration," depending on the recommendations of the doctors.

Competence to proceed is a legal definition that reflects a defendant's ability to understand the charges in a case, understand the possible penalties of conviction, contribute to the case by assisting attorneys and show proper behavior in the courtroom.

The hearing will not address Damas' mental state at the time of the killings.

Results of the completed evaluations have not been made public, although attorneys have said their conclusions differ.

Damas is charged with six counts of first-degree murder for the slayings of his wife and five children, whose bodies were found with throats cut in their North Naples home in September 2009. Prosecutors are seeking the death penalty in the case.

Damas was again outspoken in court on Friday, questioning the need for doctors to participate in his case.

"I don't need a doctor," he told Baker. "I already told you that. I'm not sick."

Damas has repeatedly asked to represent himself in his case. A team of three public defenders currently represent the defendant.

Mental competency hearing today for homicide suspect Mesac Damas

A hearing is scheduled to begin this morning to help a judge determine if accused family killer Mesac Damas is mentally competent to stand trial.

Mesac Damas, 34, of North Naples, is charged with six counts of first-degree murder in the September 2009 slaughter of his five young children and his wife, Guerline Dieu Damas, 32, inside their townhouse.

Damas, accused of slashing the throats of all six victims, faces the death penalty if convicted.

Damas is being held without bond in the Collier County Jail. He is under suicide watch.
His increasingly erratic behavior in court, including outbursts of hymn singing, quoting scripture, invoking God’s name and insisting that he represent himself, has delayed his trial and caused Circuit Judge Frank Baker to have the defendant evaluated by three mental health experts.

The experts have given differing opinions regarding Damas’ sanity.

The judge must weigh their testimony and evaluations of Damas before ruling whether he is able to comprehend the charges against him and is able to assist his attorneys with his defense. Damas is being represented by Deputy Public Defender Kathleen Fitzgeorge, Chief Assistant Public Defender Connie Kelley and Assistant Public Defender Neil McLoughlin.

The experts include psychiatrist Frederick Schaerf and psychologist Robert B. Silver, both of Fort Myers; and psychologist Michael John Herkov, of Gainesville.

If Baker rules that Damas is not mentally competent, he will be sent to a state mental hospital. There he would receive treatment designed to make him competent to stand trial. The judge could issue a ruling at the end of the hearing or take the matter under advisement and make a decision later.

This procedure is fairly common in criminal court.

As many as 80,000 defendants are evaluated each year in the United States and of those, judges find up to 20,000 who are not mentally able to stand trial, according to national experts.

However, 75 to 85 percent become well enough to eventually go to trial.
The process, however, can take years.

A local example is North Fort Myers baby killer Justin Grodin, who was eventually convicted of murdering his 11-month-old stepdaughter. It took more than nine years to bring him to trial partly because of competency issues.

Grodin in 2009 was sentenced to life in prison plus 30 years.

Sometimes, however, a murder defendant is found innocent by reason of insanity.
That’s what happened to Andrew Lee Manlove, of Naples.

Manlove in 1986 said he was walking on the beach when he heard voices telling him to go home and kill his mother, Esther Muriel Manlove. So he went home, stabbed her to death and then called police.

A judge later found him innocent by reason of insanity. Manlove has been in and out of state mental facilities ever since.

Schaerf said he also believes that Damas is competent to stand trial.

"I haven't seen any delusions. I know he's preoccupied with religion, but so are 20 million or more Americans," Schaerf said.

Instead of being mentally incompetent, "I think he's malingering," which means saying something to avoid the consequences, like when men feigned an illness to try and avoid being drafted into the military, Schaerf said.

Schaerf said Damas knows he faces the death penalty, he knows who is lawyers are and who the prosecutors are.

11:31 a.m. update — Damas is competent to stand trial and does not suffer from a mental illness or defect despite his jailhouse preaching, said Michael Herkov, a forensic psychologist and professor at the University of Florida.

Damas is able to talk coherently about his medical conditions and other subjects, but intentionally chooses not to directly discuss the murder case, Herkov said.

However, after talking with him as late Wednesday that he killed his wife and children, but that because of his belief in God, God has forgiven him.

"He was talking about being saved in the afterlife in the traditional Christian sense," Herkov said.

"He is putting himself in God's hands. There's nothing grandiose about his behavior. I could find no mental diseases or defect that would cause him to be incompetent," Herkov said.

Damas knows he faces the death penalty because "he said prosecutors wanted to kill him. I would assume he knew they were seeking the death penalty," Herkov said.

Dr. Frederick Schaerf is now testifying. He too has concluded Damas is mentally competent to stand trial.

9:31 a.m. update — Mesac Damas has twice interrupted his competency hearing that is underway, invoking the names of God and Jesus.

"I don't have my mother, my sister, my children, my wife, but one thing I have is Jesus ... he completes my life," Damas shouted before being led out of the courtroom to a holding cell.

That type of behavior indicates that Damas is delusional and unfit to stand trial, said Robert Silver, a Fort Myers psychologist whose testimony Damas interrupted.
"Mr.. Damas is here physically, but not mentally," said Silver.

Is it that Damas is not competent, or is it that's he's faking to avoid prosecution on six charges of first-degree murder, asked Assistant State Attorney Richard Montecalvo.

Silver replied that he described the nature of the charges to Damas and a possible death penalty and "all he did was preach to me."

The hearing is continuing. Damas, holding his head in his hands, is back in the courtroom

Judge rules Mesac Damas competent to proceed in death penalty case

Mesac Damas is competent to proceed in his death penalty case, a Collier Circuit judge ruled on Thursday.

The decision means Damas’ case will not immediately be delayed by treatment. Damas faces charges that he killed his wife and five children, Judge Franklin Baker issued the five-page order on Thursday, one week after three doctors testified about evaluations they conducted on the defendant.

Competency is the legal definition of a defendant’s ability to understand and participate in a court case at any one time. Questions of mental illness have surrounded Damas’ case since his 2009 arrest and through frequent court outbursts.

During last week’s competency hearing, two out of three doctors testified that Damas understood the charges against him and was capable of helping his attorneys, but that he chose not to.

In his order, Baker wrote that he found the two doctors’ testimony more compelling than a third doctor, who diagnosed Damas with “delusional disorder” and deemed him incompetent. Baker said his decision also stems from his own observations of Damas in court.

“More specifically, the Court finds that Defendant has the ability, if he so chooses, to cooperate with his lawyers and to manifest appropriate courtroom behavior,” the order stated. “If he chooses not to do so, he does so at his peril.”

A new status hearing is expected to be set in the case shortly.

Damas faces possible execution by the state if convicted of any of six charges of first-degree murder. The bodies of his wife, Guerline, 32, and the couple’s five children were discovered in the family’s North Naples home in September 2009, their throats cut.

The children were Zack, 9; Maven, 6; Marven, 5; Megan, 3; and Morgan, 19 months.

A spokeswoman for the State Attorney’s Office lauded Baker’s decision.

“With the judge’s ruling, we can now proceed more efficiently as we work towards a trial,” Samantha Syoen wrote in an email statement.

Neil McLoughlin, one of Damas’ three public defenders, said the decision speaks for itself.

“What’s there to say? Especially in death penalty cases, you always are concerned about your client’s mental health,” he said. “And let’s be honest, he exhibits bizarre behavior.”

Damas frequently speaks aloud during court hearings, invoking religion and questioning Baker’s authority. He confessed to a Daily News reporter shortly after the slayings, and he has repeatedly asked to be executed.

Two psychologists and a psychiatrist examined Damas between October 2010 and last week. Damas refused to participate in each evaluation, instead preaching at the three men.

One, psychologist Robert Silver, diagnosed Damas as bipolar after a first evaluation. After a second examination in June, he determined the defendant suffered delusions of grandiosity and was incompetent to proceed, failing to understand the charges and penalties he faced.

Psychiatrist Frederick Schaerf and psychologist Michael Herkov reached a different conclusion after their evaluations. Both consulted jail logs and medical records and decided Damas did understand the charges and penalties, based in part on his interactions with jail staff. They said he was capable of helping his attorneys but chose not to do so.

Baker noted the distinction between a defendant’s inability to assist in his defense and his willingness to do so. He also wrote that Damas’ possible mental illness has little bearing upon his competency.

“The fact that Defendant may have a mental illness is certainly relevant to the issue of competency, but it is not determinative,” he wrote.

The likely next question in the case is whether Damas should be allowed to represent himself, as he has repeatedly requested. Baker has promised to address the issue with Damas, and he suggested last week that, should the defendant be found competent, the court would explore it.

The court may also choose to again explore Damas’ competency down the road, if it feels his behavior merits it.

NAPLES — A judge denied Mesac Damas' request Friday to represent himself in court on six first-degree murder charges.

In a hearing that lasted about 10 minutes Friday morning, Collier Circuit Judge Franklin Baker said he was "not close to being confident" Damas was capable of representing himself in the death penalty case.

"You have two good lawyers. I want to keep them involved in your case," Baker said.

Baker repeatedly asked Damas why he wanted to represent himself, but Damas never addressed any legal reasons. Damas only invoked religious themes, adding, "I don't have a case."

Damas' murder charges stem from the death of his 32-year-old wife, Guerline, and the couple's five children. Their bodies were found with slashed throats in the family's North Naples home in 2009.

Damas confessed to the killings to a Daily News reporter before he was extradited from Haiti to Collier County after his arrest. He could face the death penalty if convicted on any of the six first-degree murder charges.

Invoking religious references, the 35-year-old has repeatedly stated in court that he wants to defend himself, a request that Baker has delayed as three psychiatrists evaluated Damas’ competency to stand trial.

“I want my Lord, my God, my savior to represent me,” Damas said in court during a January hearing.

Nancy Daniels, president of the Florida Public Defender Association, said self-representation requests “come along from time to time.”

“You have the right to self-representation just as much as you have a right to representation,” Daniels said. “But if you’re going to be in a position where you’re going to totally not handle the trial and you’re going to turn it into a farce and mockery, then the court has some right to keep some reasonable limits.”

Three public defenders are working Damas’ case. Attempts to reach Neil McLoughlin, one of Damas’ public defenders, on the phone or by email this week were unsuccessful.

Two of the three psychiatrists who evaluated Damas said he understands the homicide charges against him and is capable of assisting his attorneys but chooses not to.

The Constitution grants a defendant the right to self-representation, though a defendant can’t use a lack of legal knowledge as basis for an appeal. The U.S. Supreme Court ruled in 2008 that judges can deny that right in cases of defendants “who still suffer from severe mental illness to the point where they are not competent to conduct trial proceedings by themselves.”

Questions have been raised about Damas’ mental health throughout the case, heightened by his frequent court outbursts. The psychiatrist who argued Damas wasn’t competent to stand trial said Damas has a “delusional disorder.”

In his order stating Damas was competent to stand trial, Baker wrote “The fact that Defendant may have a mental illness is certainly relevant to the issue of competency, but it is not determinative.”

In requests for self-representation, judges also can appoint a public defender as “standby council,” allowing the defendant self-representation but providing a lawyer if needed periodically.

“It’s usually a very awkward hybrid of representation in which the public defender is not actually professionally responsible, but are responsible if the defendant has any questions or needs assistance on nuts and bolts issues,” Daniels said. “You’re sitting there watching things you know aren’t being done the right way, and yet you’ve been officially removed from representation.

“It’s kind of a one foot in, one foot out situation.”
