MS State supreme court sets execution for Simmons

JACKSON, Miss. (AP) - The Mississippi Supreme Court has set a June 20 execution date for 49-year-old Gary Carl Simmons Jr.

The court late Tuesday set the date and granted Simmons' request for in-person contact visits with a forensic psychologist and a neuropsychologist for the purpose of conducting mental health evaluations. His attorneys had argued that the mental evaluation was necessary because Simmons may have post-traumatic stress disorder or other illnesses and had suffered from abuse as a child.

Simmons was convicted for shooting and dismembering Jeffrey Wolfe, who was killed in August 1996 after going to Simmons' Pascagoula home to collect on a drug debt.

This sounds like a fishing expedition to me, you can be almost certain they will come up with some BS reason for him not to be executed.

PTSD is no excuse for murder! I have it and I know numerous others that have it and none of us would consider murder as an option!

They say more time is needed for two mental health evaluations and an appeal based on their results.
 
On June 5, the court set the execution date for Simmons. The 49-year-old was convicted of shooting and dismembering Jeffrey Wolfe in August 1996 in Pascagoula. Also June 5, the court granted Simmons' requests for evaluations by a forensic psychologist and a neuropsychologist.
 
Lawyers argue Simmons suffers mental illness and was abused as a child. If evaluations support those claims, lawyers want the court to order Simmons resentenced, giving him a chance to avoid execution.
 
However, lawyers say in court papers filed Monday that there's not enough time before June 20 for evaluations and an appeal.

Yea I have a mental disorder I hate scum bags.  I also had a rough childhood.  I'm not on death row..

 So based on these finding's using me as the base line. I find him to be normal ,and worthy of a painful death...

The argument of a crap childhood is the most BS one ever!! It's not what happened in your past it's WHAT YOU DID NOW that matters. If abuse as a child was a precursor to violent murder there would be far more women than men on death row, after all, statistically they are far far more likely to be abused as children than males are.

JACKSON, Miss. (AP) — The Mississippi attorney general's office argued in a court filing Wednesday that an inmate's recent request for mental health testing is a tactic to delay his execution, scheduled for Tuesday.
 
Gary Carl Simmons, who had worked as a grocery store butcher, was convicted of killing a man who was shot and dismembered in Pascagoula in 1996.
 
Simmons' attorneys have asked the Mississippi Supreme Court to stay his execution for two weeks because they say more time is needed for two mental health evaluations and an appeal based on their results.
 
On June 5, the court set the execution date for Simmons, but granted his requests for evaluations by a forensic psychologist and a neuropsychologist. The lawyers filed another motion Monday that says there isn't enough time before the execution for evaluations and an appeal based on the results, "if warranted."
 
The Mississippi attorney general's office responded Wednesday in a court filing that said the request for mental evaluations is a delay tactic and the court should rescind its order and deny a stay of execution.
 
Simmons' lawyers argued that he suffers from a mental illness and that he was abused as a child. If evaluations support those claims, lawyers want the court to order Simmons resentenced, giving him a chance to avoid execution.
 
The attorney general's office filing said Simmons' "sanity is not in question" and that if he's allowed to get the evaluations then other death row inmates will ask for the same type tests to delay their executions.
 
In a response filed Wednesday, Simmons' attorneys argued that his due process rights would be violated if there's not sufficient time for the evaluations.
 
Simmons, now 49, was convicted of killing Jeffrey Wolfe in August 1996.
 
Wolfe had gone to Simmons home to collect a drug debt. Timothy Milano, Simmons' co-defendant and the person authorities said shot Wolfe, was convicted on the same charges and sentenced to life in prison.
 
Police said Simmons and Milano kidnapped Wolfe and his female friend and later assaulted the woman and locked her in a box. Police said they later found parts of Wolfe's body at Simmons' house, in the yard and in a nearby bayou. The woman was not killed.

JACKSON -- The Mississippi Supreme Court today denied a motion for a stay of execution for Gary Carl Simmons.

Simmons, 49, is scheduled to die by lethal injection on Wednesday for the 1996 murder of Texas man Jeffrey Wolfe and the rape of his female companion.

The crimes occurred in the Kreole area of Moss Point. Simmons' former brother-in-law, Timothy Milano, shot Wolfe in the back before Simmons, at the time a grocery store butcher, dismembered the body and dumped it in the bayou behind his home.

Simmons is said to have owed Wolfe a substantial amount of money for drugs.

Milano was sentenced to life in prison without the possibility of parole.

Simmons' lawyers last week asked for a stay of execution to give doctors time to evaluate and write reports on Simmons. They allege he suffered abuse as a child and had post-traumatic stress that may have contributed to his state of mind at the time of the crimes.

Media Witnesses Selected for Simmons Execution

JacksonThe Mississippi Department of Corrections (MDOC) today announced the selection of media witnesses for the June 20 scheduled execution of Gary Carl Simmons. Three media representatives were selected by lottery at 10:00 a.m. today at the MDOC Central Office Headquarters in Jackson and will join a representative from the Mississippi Associated Press.

5'11" 264 pounds...2.5g of pentobarbital will get it done!  ;D ;D ;D
