A Baton Rouge judge set a May 9 execution date for Todd Wessinger, who was convicted in 1997 and condemned to die in the 1995 slaying of two Calendar’s Restaurant employees.

State District Judge Richard Anderson set the execution date on Friday, nine days after U.S. District Judge James Brady denied Wessinger’s bid for a new trial or sentencing.

Wessinger, a former dishwasher, was found guilty and sentenced to die by lethal injection for fatally shooting Stephanie Guzzardo, 27, and David Breakwell, 46, at the now-closed Perkins Road restaurant on Nov. 19, 1995.

Wessinger’s appellate attorneys are expected to appeal Brady’s Feb. 22 ruling to the 5th U.S. Circuit Court of Appeals in New Orleans.

The East Baton Rouge Parish District Attorney’s Office filed a motion Feb. 27 asking Anderson to set an execution date for the 44-year-old Wessinger.

“I thought it was important to have the matter moved along,’’ District Attorney Hillar Moore III said Monday.

Moore acknowledged that the federal appellate court likely will stay the execution date if Wessinger’s attorneys make such a request.  >:(

Brady rejected a dozen claims raised by Wessinger, including an allegation that his trial attorneys provided ineffective assistance during jury selection and the guilt and penalty phases of his 1997 trial in Baton Rouge.

Brady said the state’s evidence against Wessinger in the guilt phase was “overwhelming.’’

Killer seeks stay of execution in death of Baton Rouge restaurant workers, execution May 9
 
Attorneys for convicted killer Todd Wessinger, who is scheduled to be executed May 9 for the 1995 slaying of two workers at a now-closed Baton Rouge restaurant, has asked a federal judge to reconsider his recent denial of a new trial or sentencing.
 
The Advocate reports (http://bit.ly/HDLBlg ) Todd Wessinger's attorneys also asked that his execution be stayed.
 
Wessinger's attorneys want U.S. District Judge James Brady to hold an evidentiary hearing on Wessinger's federal constitutional claims. The attorneys argued that Brady issued his ruling Feb. 22 without ever holding such a hearing.
 
Wessinger, a former dishwasher at the restaurant, was found guilty and sentenced to die by lethal injection for fatally shooting 27-year-old Stephanie Guzzardo and 46-year-old David Breakwel on Nov. 19, 1995.
 
"This Court's actions throughout these proceedings led Mr. Wessinger to believe that evidentiary hearings would take place," Wessinger's current attorneys — Danalynn Recer, of The Gulf Region Advocacy Center in Houston; Soren Gisleson, of New Orleans; and federal public defender Rebecca Hudsmith, of Lafayette — contend in court filings.
 
Those attorneys electronically filed a motion Tuesday in federal court in Baton Rouge to alter or amend Brady's judgment. A supporting memorandum was electronically filed Wednesday.
 
In February, Brady rejected a dozen claims raised by the Wessinger, 44, including allegation that his trial attorneys provided ineffective assistance during jury selection and the guilt and penalty phases of his 1997 trial in Baton Rouge.
 
East Baton Rouge Parish District Attorney Hillar Moore III said Wednesday he believes the judge's decision "was sound and based on the facts presented by the record."
 
"It seems that the defense is arguing that everyone involved in this case did something wrong, including the defense lawyers, experts and the court — that is everyone but the defendant, who committed a particularly brutal murder," Moore stated.
 
(That statement could apply to just about every DP case in the country!)

"I hope that the execution date will remain intact although I anticipate more filings on behalf of the defendant to upset the carrying out of the jury's verdict," he added.
 
Brady, who described the state's evidence against Wessinger in the guilt phase as "overwhelming," said in his ruling that Wessinger faults his attorneys' penalty phase preparation for not probing further into his childhood and upbringing.
 
Wessinger contends such an investigation would have led to evidence of a physically and mentally abusive childhood, possible mental defects and an alienation from society that led him to believe he did not belong.
 
Brady ruled that Wessinger is not attacking the quality or thoroughness of the investigation but "does not like the way his story was spun for the jury."
 
"This is a clear factual error inconsistent with the record which must be revisited," Wessinger's attorneys argue in their memorandum.
 
"At penalty phase, trial counsel generally painted a rosy picture of Mr. Wessinger as 'a caring and present father, a brother who cared for his handicapped sister growing up, and a hard worker from a stable family.' Because trial counsel had not hired a mitigation specialist nor conducted any independent life history investigation, the presentation was an incomplete and inaccurate view of Mr. Wessinger," his current attorneys maintain.
 
"It is not the case, as this court suggests, that trial counsel conducted the investigation and made strategic choices about what to present," Wessinger's attorneys add.

Well of course the defense was ineffective. This POS was found guilty so obviously they didnt get it right.
Common sense isn't so common any more!!

My reason for supporting the death penalty? A murderer has less of a right to live than his victim and already presents a danger while incarcerated for life. They have nothing to lose when the most they can get is Life in prison without parole.

BATON ROUGE, LA (WAFB) - A stay of execution has been granted for a Baton Rouge man convicted of double murder.

The judge granted the temporary order Wednesday for Todd Wessinger.

A jury convicted Wessinger in 1997 for the murders of his co-workers, Stephanie Guzzardo and David Breakwell, at the now-closed Calendar's restaurant. 

Wessinger's execution was scheduled to happen on May 9.
 
Earlier in the month, Wessinger asked a federal judge to reconsider his request for a new trial.
 
There has been no word on when the judge will rule on a permanent stay of execution.

My reason for supporting the death penalty? A murderer has less of a right to live than his victim and already presents a danger while incarcerated for life. They have nothing to lose when the most they can get is Life in prison without parole.

Wessinger’s execution put on hold

A federal judge granted a stay Wednesday of the scheduled May 9 execution of a Baton Rouge man for the 1995 murder of two restaurant workers.

Todd Kelvin Wessinger, 44, was convicted in 1997 for the murders of 27-year-old Stephanie Guzzardo and 46-year-old David Breakwell at the since-closed Calendar’s restaurant on Perkins Road. A state court jury sentenced Wessinger, who had worked at the restaurant as a dishwasher, to death by lethal injection.

But appellate attorneys Danalynn Recer, of The Gulf Region Advocacy Center in Houston; Soren Gisleson, of New Orleans, and Federal Public Defender Rebecca Hudsmith, of Lafayette, are seeking an evidentiary hearing in federal court to consider mitigating factors favorable to Wessinger.

In February, U.S. District Judge James J. Brady denied Wessinger a new trial, as well as a new sentencing hearing.

Brady ruled then that the state trial evidence against Wessinger was “overwhelming.”

The judge also noted that Wessinger alleges his trial attorneys were ineffective.

“In short, it is not the quality or thoroughness of the investigation Wessinger is attacking, he essentially does not like the way his story was spun for the jury,” Brady wrote in February. “This is not ineffective assistance.”

Brady added: “Defense counsel seems to have bet heavily on a strategy of painting Wessinger as a good person who suffered from alcoholism and was not his normal self when he committed the murders and that a life sentence would not endanger the lives of other inmates.”

The judge repeated: “The fact that the jury rejected this theory does not make counsel ineffective.”

Last week, Assistant District Attorneys Dale R. Lee and J. Christine Chapman urged Brady to reject new defense requests for an evidentiary hearing and stay of Wessinger’s execution.

Lee and Chapman argued that the families of Guzzardo and Breakwell “have endured years of uncertainty and appeals. They undoubtedly endure harm each day that the lawful sentence of the court is not carried out, and they are clearly entitled to finality and closure.”

On Monday, however, defense attorneys filed documents alleging Wessinger suffered childhood seizures and physical and emotional abuse, developed substance addictions and was traumatized by the deaths of his children.

Wessinger’s appellate attorneys also alleged that trial attorney J.W.P. “Billy” Hecker should not have called Dr. Phillip Louis Cenac Jr. to the trial witness stand without first going over Cenac’s report about his interviews with Wessinger.

Cenac testified Wessinger told him: “He was surprised initially by the cook, who was behind the door of a refrigerator, apparently a commercial-sized refrigerator, and he shot him. Subsequently, he shot Alvin Ricks and then the female manager of the store. Then he left.”

Cenac added: Wessinger “continued about his business and was told by … girlfriends through his pager that he was a suspect in the Calendar’s shootings. Subsequently, he went to Dallas.”

Another expert witness for the defense, Dr. Carey Rostow, a psychologist, testified at trial that Wessinger was “explosive.”

Rostow added that Wessinger “does not play by the same rules that most people do. He sees the world as a place that is there to meet his needs.”

An affidavit by Hecker was attached to the appellate team’s filing on Monday.

Hecker said in that affidavit that he did not have sufficient time to interview Cenac and Rostow before their testimony.

“It was not strategy on my part to put such important witnesses on the stand without knowing the full content of their testimony,” Hecker wrote. “And if I had known that they would call my client a liar, dangerous, and testify that he had confessed, I would not have called them as witnesses.”

Lee, the assistant district attorney, told Brady on Wednesday that the defense “still put on a very thorough penalty-phase case.”

Added Lee: “Mr. Wessinger, in this case, got a fair trial.” He urged Brady not to grant “a new trial.”

Brady said he would take both sides’ arguments under advisement.

The judge granted Recer’s request for a stay of Wessinger’s execution while he works on his decision. He did not say when that decision would be announced.

Todd Wessinger was scheduled to die on May 9th but a last minute stay of execution was issued by Judge James Brady to allow arguments to be made by Wessinger’s attorneys.
 
Last week those arguments were heard by Judge Brady and although four of five of the claims made by the defense were thrown out by the Judge, he did rule that Wessinger’s claim of “ineffective assistance of counsel at the penalty phase of the trial” was valid, and at least deserved a hearing to look into it further. The hearing was scheduled for December 13th, 2012, leaving it very unlikely his execution will be carried out in 2012.
 
Early in the year, Judge Brady denied Wessinger’s request for a new trial, claiming that there was an overwhelming amount of evidence pointing to his guilt in the case, however, his attorney’s did not present all pertinent facts about Wessinger’s mental state and abusive childhood  in the penalty phase of his trial where he was sentenced to death.

I really hate the 'Abusive Childhood" excuse. Whilst i had a very good childhood I do have less fortunate acquaintances who are normal contributing members of society.
 
Surely the ONLY consideration here is did his past prevent him from knowing right from wrong? If he knew what he was doing was wrong then I don’t see how his past makes one pinch of difference? He should be punished for what he did not given extra care and consideration for his past! This is a murder case he didnt steal a loaf of bread to feed his kids!!

I agree and if he didn't like what was done to him in his childhood then it stands to reason he realized it was wrong which furthers the notion that he knew killing was wrong...

Maybe I'm just stoopid, but I would think that the "abusive childhood" defense would be all the more reason TO execute the guy. After all, if he was beaten to a pulp by his parents as a child, knew darned well that it felt less than enjoyable, and as a result, felt the need to murder two OTHER people, then surely putting in timeout for the rest of his life wouldn't be enough to convince him otherwise. That person remains a danger, even behind bars, and as such, in the opinion of this one individual poster, should be put to death.
