Ohio Supreme Court sets execution date for Akron man who raped, killed 3-year-old

Ronald Phillips to die Nov. 14,

COLUMBUS, Ohio - The Ohio Supreme Court has set execution dates for an Akron man who raped and killed a 3-year-old girl and for a southwest Ohio man who raped and killed a pregnant woman.

The court on Friday set one of the executions for late 2013 and the other for the beginning of 2014.

The first new execution on the calendar is for Ronald Phillips, of Akron, who was convicted in the killing of his girlfriend's 3-year-old daughter back in 1993. He's now set to be put to death on Nov. 14, 2013.

The court also says Dennis McGuire of Preble County is now scheduled to be executed on Jan. 16, 2014. McGuire was sent to death row for the 1989 rape and stabbing death of a woman who was pregnant.

Jeebus, Ohio has as many baby rapists as Florida.  What is in the water over there?  But I am sure if I read through PA's DR, I am sure I'll find the same thing.  But a three year old is really, really bad, almost as bad as Steven Smith, the only difference in that this victim could physically say no. >:( >:( >:( >:(

Ohio plans to come up with a new process for executing condemned inmates no later than Oct. 4 as the supply of its current drug is ready to expire, according to a court filing.

The new process, which is not spelled out in the filing, will apply to the November execution of Ronald Phillips, sentenced to die for raping and killing his girlfriend's 3-year-old daughter in Akron in 1993, according to the order filed Monday by federal judge Gregory Frost.

Frost's order, reviewed by The Associated Press, notes that the process won't be in place for next month's execution of Harry Mitts. The Department of Rehabilitation and Correction raised the Oct. 4 date in a recent telephone conference with the judge, according to the order.

The state did not immediately respond to a request for comment, but said a statement was forthcoming.

The change in the execution process is necessary because supplies of the sedative pentobarbital, the drug Ohio uses for executions, have been put off limits by its manufacturer, and the state's remaining supplies expire at the end of September.

One option floated by Ohio authorities is obtaining the drug from compounding pharmacies, which are licensed to create small batches of drugs for specific clients.

This would be the third time the state has changed its protocol because of difficulty finding an execution drug. Manufacturers also restricted distribution of sodium thiopental, the drug used before pentobarbital.

Killer of Sheila Marie Evans scheduled for execution

Ronald Ray Phillips of Akron has been scheduled by the Ohio Supreme Court to be executed in November 2013 for the rape and aggravated murder of his late girlfriend’s daughter, Sheila Marie Evans, nearly 20 years ago.

It was one of the city’s most notorious and heart-wrenching crimes of the 1990s.

According to Akron Beacon Journal archives of the trial, former Summit County Coroner William Cox testified that the autopsy revealed more than 130 bruises on Sheila Marie’s body. 

Dr. Cox, who performed the autopsy on Sheila’s body, testified that on the day of her death she suffered numerous internal and external injuries from multiple blows, and that, based on a reasonable medical certainty, these blows caused Sheila’s death.

He elaborated:

The cause of death is cardiovascular collapse due to hemorrhage, hemorrhage into the soft tissue of the pelvis and into the small and large bowel due to multiple acute contusions, with perforations of the duodenum, complicated by perforation of the superior mesenteric artery and vein due to blunt force trauma, complicated by brain swelling with herniation.

She was 3 years old when she died of internal injuries at Akron Children’s Hospital on Jan. 18, 1993.

“When you’re talking about the rape and murder of a 3-year-old, that’s about as bad as it gets,” retired Assistant Summit County Prosecutor Michael Carroll said Monday.

Carroll and the late Judith Bandy, two of the most experienced prosecutors in the office at the time, handled the government’s case against Phillips.

“I’ll never forget Dr. Cox testifying as to the number of injuries. They were just unbelievable,” Carroll said.

“As a matter of fact, we almost lost a juror, who nearly passed out, from the [autopsy] photographs that the doctor showed. It was just terrible.”

The high court set Phillips’ execution date for Nov. 14, 2013.

He is 38 and has been confined on death row, in a 6-by-8-foot cell at the Ohio State Penitentiary in Youngstown, since Sept. 16, 1993, prison records show.

Prison spokesman Carlo LoParo said the execution date was set last week after the high court determined that he had exhausted all of his state appeals.

His late girlfriend, Fae Amanda Evans, was convicted of involuntary manslaughter and child endangering for her involvement.

Evans, who was 41, had been locked up for 15 years at the Ohio Reformatory for Women in Marysville. She died of cancer on July 8, 2008, at the state prison hospital in Columbus, LoParo said.

Carroll said there were some issues about her direct involvement in the crime, “but what she wasn’t doing,” he said, “was taking care of the child, or preventing any of this from happening.”

Unfortunately, every time the execution protocol changes it give new fodder for the defense to ask for a stay.  And unfortunately, too often their is some anti judge who will grant the defense motion.   >:(

LUCASVILLE — Ohio is looking to the future of its execution procedure after the lethal injection of a killer whose death exhausted the state’s last unexpired dose of its execution drug, the powerful sedative pentobarbital.

Harry Mitts Jr., 61, was executed Wednesday at the state prison in Lucasville. The white gunman spewed racial slurs before fatally shooting a black man and a police officer in a 1994 rampage that prosecutors called one of Ohio’s worst crimes.

Prisons director Gary Mohr said the state is on track to tell a court by Oct. 4 how its executions will proceed now that its drug supply has expired.

“We are looking at whether we need to change the protocol or not, quite frankly,” he told reporters at the Southern Ohio Correctional Facility.

A prisons agency lawyer said earlier this year legislation may be needed to protect specialty pharmacies that might mix supplies of execution drugs from sanctions like losing their state accreditation. So-called compounding pharmacies mix specific doses of drugs for patients.

When asked Wednesday if Ohio will have to choose a different drug whether or not it changes its execution rules, Mohr said “not necessarily.” He declined to elaborate.

The new process will apply to the November execution of Ronald Phillips, sentenced to die for raping and killing his girlfriend's 3-year-old daughter in Akron in 1993, according to the order filed by federal judge Gregory Frost.

Ohio adds new execution method after supplies of go-to lethal injection drug dry up

 The Ohio Department of Rehabilitation and Correction on Friday announced it would soon allow a new chemical cocktail to be shot intravenously during lethal injections.

 Department rules allow a combination of midazolam and hydromorphone to be injected directly into a condemned inmate’s muscles if the DRC’s drug of choice, pentobarbital, is unavailable.  8)

 But a new policy -- effective Oct. 10 -- will allow midazolam, a sedative, and hydromorphone, a morphine derivative, to be injected directly into an inmate’s veins instead of his muscles.

“DRC is not eliminating or changing any current execution drugs or method,” DRC spokeswoman JoEllen Smith said in an email. “The policy has been enhanced to allow for a second, alternative intravenous drug due to difficulties in obtaining pentobarbital.”

 Ohio used pentobarbital Sept. 25 to carry out the execution of Garfield Heights double murderer Harry Mitts Jr. and the remaining supply of the drug expired at the end of September.

 Supplies of pentobarbital around the country thinned out after its European manufacturer said the drug is not intended for executions and blocked sales. The move forced Ohio and other states to consider alternatives.  The DRC could replenish its pentobarbital supply if another manufacturer is found, Smith said.

Ohio’s next lethal injection – the execution of Summit County killer Ronald Phillips –is scheduled for Nov. 14. Phillips could be the first in the state to be injected with the duo of backup drugs.

 The state executed 10 men using pentobarbital since the drug’s introduction in 2011.

Not only the truth to come out, but to show that people can change and they are not the same person they were once before. People do learn from thier mistakes.
My crime did not happen the same day as the State has lied for 20 years now.
The State used a coroner that was corrupt, flat out lied to bootstrap a case that was tried by the press.
A judge talking to the jury when no one was present to object to what the jury wanted to know about the case.
A grand juror screaming to the jurors on my case that I should get the max.
A defence attorney later representing the corupt coroner in his criminal case(s).
Failure to check doctor appointments that were changed from Friday to a monday.
Phone records never presented. A co-defendant keeping silent untill her death.
Defense attorneys failed to investigate any state witnesses.
IE.. Coroner William X. His business practices, stealing money for personal reasons.

COLUMBUS, Ohio (AP) — A death row inmate who raped and killed his girlfriend's 3-year-old daughter was sexually, physically and verbally abused during his childhood, according to attorneys asking the Ohio Parole Board to spare him before next month's execution.

No judge or jury ever heard the full story of the abuse suffered by Ronald Phillips, which included being repeatedly raped and beaten by his late father, according to a document filed with the board ahead of Wednesday's clemency hearing.

"Ronald Phillips is not and was not a monster," his attorneys said in the filing. "Ronald Phillips instead was a 19 year old high school student, who had experienced nothing but violence, chaos, and abuse, and who learned through those life experiences that violence and abuse were the norm."  ;D ;D ;D ;D ;D ;D ;D ;D

Phillips, 40, is scheduled to die Nov. 14 for raping and killing Sheila Marie Evans in Akron in 1993 after a long period of frequently abusing her.

If his execution proceeds, Phillips would be the first person to die under the state's new execution procedures. That policy allows Ohio to continue to use the sedative pentobarbital but with the option of buying it from a specialty pharmacy which produces non-FDA-regulated batches of medicine for specific patients.

If that option isn't available, the state can move to a never tried method of two other drugs — the sedative midazolam and the opiate hydromorphone — injected intravenously.

The warden at the Southern Ohio Correctional Facility, which houses death row, will determine by Nov. 1 whether the state has a usable supply of pentobarbital.

A federal judge is reviewing Ohio's new method and legal challenges are expected.

The state says Phillips long denied suffering the type of abuse he now alleges. Summit County Prosecutor Sherri Bevan Walsh says Phillips is only raising it now with his execution imminent. She urged the board to reject the claim.

"It is curious that the disclosures have been made now, on the eve of his execution and after his father's death," Walsh said in a response to Phillips' clemency plea also filed with the parole board.

Phillips' attorneys say he was only able to reveal the abuse recently to them and to two psychologists.

The board will recommend for or against mercy next week. Gov. John Kasich has the final say.

Phillips' father, Williams Phillips Sr., died in 2009. His mother, Donna Phillips, declined to discuss the allegations against her late husband, who she acknowledged could be "stern."

"He's not here to defend himself and I don't believe it should be anything said about that," she said in a phone interview.

She said her son is sorry for what happened.
