Finally ready to tell my story

Hi Everyone!

I have been a member of this site for some time and a "stalker" before that.  I'm now ready to explain why I'm here  :) 

In 1987 my Uncle was murdered and robbed by his girlfriends son.  I was a senior in high school at that time and there isn't  a day that I do not think about this tragic event that changed my family forever.  Due to our lack of knowledge and state of shock, we agreed to allow the Prosecutor to agree to a plea deal.  He was sentenced to 20 yrs. to life for the murder and 8 to 15 yrs. for the robbery.  Little did we know that he would have his 1st parole hearing after only 6 years!  Subsequently after the 1st parole hearing and having to relive all the tragic events that occurred....we had to do this again and again every couple of years unless of course he received a special hearing due to some jailhouse lawyer winning a point on their case which was similar in facts or sentencing and then we'd be faced with it more frequently.  On January 17, 2007 he was paroled from prison.  Not a day goes by that I do not worry about the safety of my family with this murderer running free.  There is no healing and there is no closure, but I believe if he would have received the DP, my family would now be able to live in peace.

I am totally Pro DP and my heart goes out to any person who has ever had to live through the murder of a loved one.  Thank you for this wonderful site!

How I empathise with you. The murderer of my ward lives nice and free in Paris. I hope that you will find support and friendship here and the occasional laugh!

This is why I would advise not to testify at parole hearings.  It re-open the wound and puts you at risk for what you may say.    I wouldn't be surpised if the parole boards, as opposed to juries at the penalty phase, do not even consider what the families have to say.   That would be adding an insult to the injury because they listen attentively to the prisoner.

Though of no consolation to you, the laws were changed shortly after the murder of your uncle.  Non DP sentences are much higher with no parole or with the possibility of parole only after they served the majority of the sentence.  However, 20 years later, the thug lovers are chipping away at that, too. Not only do they want to abolish the DP but they want to abolish both lwop and life with parole, IOW, make our sentencing similar to europe.

As to testifying at parole hearings or providing letters to the parole board, it should always be done.  Parole boards do consider the input of the victim's family and I know of paroles that were denied solely based on the victim's family input.

As to your safety, there is a good chance he is back in prison.  Many state DOCs now have inmate locator websites. You may want to check to see if he is back in custody.

My condolences to you.

What state was it?
My reason for supporting the death penalty? A murderer has less of a right to live than his victim and already presents a danger while incarcerated for life. They have nothing to lose when the most they can get is Life in prison without parole.

 :-*  Your story is quite similar to my own, and I truly do understand how you feel with worrying about your family's safety.  Thankfully we no longer have to worry - he hung himself in prison, but it was always on the back of our minds for 20 years.

It was Cuyahoga County in The state of Ohio.

No, I'm not a member of PTO.  I love this site!  It is very hard sometimes to discuss things that have happened or how you are feeling to your friends because they just do not get it because they have never been through anything so tragic.  Thanks again!

but I am glad that you haven't suffered the tragic loss of your wife to suicide in prison recently :-)

The people here are supportive, intelligent and you will always have someone to chat to should the need arise. I'm glad you signed up, so many of us know what it is to go through this and can offer you some comfort.

Greg it is true things have changed.....boy do I wish I knew then what I know now because I would have tried to do more.  As far as I can tell he is not back in custody.  When he was released I actually had to petition the parole board to request that a no contact order be part of his release agreement.  He was suppose to be on 5 year mndatory supervision with a parole officer, but they released him from that after a little over 3 yrs.  Now I can no longer check up on him because he has made all his myspace/facebook profiles private.  I just hope he doesn't hurt anyone else.  Thank you for all your information.
