Condemned Cleveland killer of 2 asks court for execution delay

COLUMBUS, Ohio - A man scheduled to die this week for shooting his estranged wife and brother-in-law in a courthouse basement in 1992 is so mentally ill he believes the CIA is orchestrating his execution, his attorneys said Monday as they asked the Ohio Supreme Court for a delay.  ;D ;D ;D

Abdul Awkal's mental health has been the subject of court hearings for years, and a Cuyahoga County judge ruled Monday that there was enough evidence that Awkal was insane to justify a hearing about his competency.

"In 2001, Mr. Awkal wrote the CIA and offered his assistance in the war on terrorism," his attorneys said in Monday's filing. "Since then, he has been writing CIA directors, Presidents Bush and Obama, and news media to explain his plans for Mideast foreign affairs."

The attorneys included a report by California psychiatrist Pablo Stewart, who reviewed Awkal's case history and interviewed him on death row in Chillicothe on May 25.

Stewart said the 53-year-old Awkal doesn't understand why he is being executed and instead lives in a fantasy world where he believes he is crucial to the nation's Mideast war effort, according to the affidavit.

"Awkal's delusions prevent him from truly understanding that the crimes he committed in 1992 are the reason for his execution," Stewart wrote.

The attorneys say a delay is necessary to conduct a proper court hearing on Awkal's competency before Wednesday's execution.

The state opposes the request, and both Gov. John Kasich and the Ohio Parole Board rejected Awkal's request for mercy based on his mental health allegations.

They also say that Awkal is unlikely to win his argument in court and that a delay at this stage is unnecessary. The request isn't fair to the surviving family members of Awkal's victims, prosecutors added.

Awkal told two other doctors he was going to be executed for his crimes, prosecutors said. "The evidence shows that Awkal is competent to be executed," they said. "He admits committing the murders, he knows he is scheduled to be executed on June 6, 2012."

The parole board voted 8-1 against recommending mercy, with most members concluding that Awkal planned the shooting and that it wasn't the result of a psychotic breakdown.

While he had asserted remorse, "he clearly blames the victims for allegedly creating the circumstances that forced him to kill them," the board said on May 18.

The Cuyahoga County judge's decision isn't enough to stop the execution, and it's likely that Awkal will be moved Tuesday morning to the death house at the Southern Ohio Correctional Facility in Lucasville.

Awkal was sentenced to death for killing his estranged wife, Latife Awkal, and brother-in-law Mahmoud Abdul-Aziz in January 1992 in a room where the Awkals were to take up divorce and custody issues.

In the months before the shooting, Awkal bought a pistol and threated to kill his wife and her family if they didn't dismiss the divorce proceedings. Prosecutors said Awkal also changed his address and wrote his brother a check for most of his assets before heading to court on the day of the shooting.

If put to death, 53-year-old Abdul Awkal (ab-DUHL' AW'-kuhl) would be the second man Ohio executes since lifting an unofficial moratorium on the death penalty that lasted six months.

Awkal, whose execution is Wednesday, was sentenced to death for shooting Latife Awkal (la-TEE'-feh AW'-kuhl), his spouse from an arranged marriage, and brother-in-law Mahmoud Abdul-Aziz (mak-MOOD' ab-DUHL'-ah-ZEEZ), as the couple was taking up divorce and custody issues.

Awkal's attorneys asked the state Supreme Court Monday to delay the execution to allow a hearing on Awkal's mental competency.

The state opposes the delay and Awkal's earlier requests for clemency were denied.

Not to be picky but if the scheduled execution is set for tomorrow, June 6, shouldn't the date on the folder be changed from 6/12 to 6/6?

COLUMBUS, Ohio (AP) -- A condemned Ohio inmate awaiting execution in less than a day is in good spirits and has ordered a last meal consisting mostly of vegetables.
 
Abdul Awkal (ab-DUHL' AW'-kuhl) has been moved to the state's death house at the Southern Ohio Correctional Facility where he is about to begin visits with a lawyer and a friend.
 
Prisons spokeswoman JoEllen Smith says Tuesday that Awkal has been laughing and talking with execution team members.
 
Smith says Awkal's special meal, to be served after his visits, consists of cabbage, cauliflower, lettuce, carrots, cucumber, corn and tomatoes.  ::)
 
He also ordered ice cream, cheese pizza and Pepsi

Republican Gov. John Kasich on Tuesday issued a rare last-minute reprieve for a condemned killer, sparing Abdul Awkal for two weeks to allow a judge to hold a hearing on his mental competency.

Kasich ordered the delay to allow a Cuyahoga County judge to conduct a hearing on whether Awkal is too mentally ill to be put to death. Judge Stuart Friedman ruled Monday there was evidence to believe Awkal was not competent to be executed, but his ruling was not enough to stop the execution.

Kasich's decision came shortly after the Ohio Supreme Court had refused to delay the execution to allow the hearing. Governors in Ohio have the ultimate say on executions.

Former death row inmate John Spirko received reprieves from two governors before he was spared, but such interventions by governors have been infrequent since Ohio resumed executions in 1999.

Awkal was sentenced to death for killing his estranged wife, Latife Awkal, and brother-in-law Mahmoud Abdul-Aziz in January 1992 in a room where the Awkals were to take up divorce and custody issues.

In the months before the shooting, Awkal bought a pistol and threatened to kill his wife and her family if they didn't dismiss the divorce proceedings. Prosecutors said Awkal also changed his address and wrote his brother a check for most of his assets before heading to court on the day of the shooting.

Awkal was in the state death house at the Southern Ohio Correctional Facility in Lucasville when the decision was announced. He arrived at Lucasville earlier Tuesday and had been in good spirits during his stay.

If put to death this month, Abdul Awkal would be the second man Ohio executes this year since the end of an unofficial moratorium on capital punishment that lasted six months.

Awkal's mental health has been the subject of court hearings for years.

A court initially found him not competent to stand trial because of his severe depression. He was sent to a mental health center and put on antidepressant and anti-anxiety medications before the court found him competent for trial, where he was convicted of aggravated murder.

Awkal claimed to have sent war plans to President Barack Obama and former President George W. Bush, communicated with the CIA and FBI and played a central role in managing the wars in Iraq and Afghanistan, his attorneys said as evidence of his mental condition.

In an interview last month with the parole board, Awkal admitted his actions were wrong. He spoke of having a previous nervous breakdown and said that he had not cheated on his wife but that she had been with other men. He said he "snapped" at the courthouse when his wife prevented him from holding his daughter, and he denied using the child as a shield when he tried to flee and was shot by officers.

The state opposed the request for a delay, and Kasich and the Ohio Parole Board rejected Awkal's request for mercy based on his mental health allegations.

Cuyahoga County Prosecutor Bill Mason said a delay at this stage was unnecessary and the request wasn't fair to the surviving family members of Awkal's victims.

Of the state Supreme Court's seven justices, two, Paul Pfeifer and Terrence O'Donnell, would have granted the delay, allowed Awkal to be re-interviewed by a psychiatrist and required the court to set a new execution date, according to Tuesday's ruling.

Awkal had already ordered a special meal, as the last meal is called in Ohio, of cabbage, cauliflower, lettuce, carrots, cucumber, corn and tomatoes. He also ordered Bear Claw ice cream, a large pizza with double cheese and Pepsi.

Awkal appeared to be "in very good spirits, laughing and talking with execution team members," prisons spokeswoman JoEllen Smith said earlier Tuesday.

The Ohio Parole Board voted 8-1 last month against recommending mercy, with most members concluding that Awkal planned the shooting and that it wasn't the result of a psychotic breakdown.

Every single time I read something like this I am more and more dumbfounded by opponents of capital punishment. He will be half drunk, drugged up from sedatives when he dies an impaired, euphoric death after having a filling last meal, saying goodbye to his loved ones, and getting the chance to speak his last words. That is NOTHING like being ambushed and shot to death in the crappy basement of an old courthouse. Even with the death penalty there is no real JUSTICE in the true sense of the word. True justice would be him locked in a building with someone he once trusted hunting him down and shooting him to death as he huddled in the corner of a room. And then has the gall to ask for special treatment while on the row?? Are you kidding me?!?! You have already received your "special treatment"! We didn't fatally shoot you with a handgun at point blank range like you truly deserved. Every day you have had a pulse since then is a gift and special treatment. So long, Awkal...Hell eagerly awaits you.

Well I guess he can say he has compassion.. It was not needed in this case..But what ever.. Its a save face move.

COLUMBUS, Ohio (AP) — A county judge says he's glad Ohio's governor granted a two-week reprieve for a condemned inmate so the judge can reconsider the man's mental competency before his scheduled execution.

Gov. John Kasich's (KAY'-siks) decision this week set a new June 20 execution date for Abdul Awkal (ab-DUHL' AW'-kuhl). He was sentenced to death for killing his estranged wife and brother-in-law in a Cleveland courthouse in 1992.

Awkal's attorneys argue he's so mentally ill he believes the CIA is orchestrating his execution. The state opposes any delay, saying several courts have upheld Awkal's competency.

Cuyahoga (ky-uh-HOH'-guh) County Judge Stuart Friedman will preside over the mental competency hearing next Thursday. Friedman tells The Columbus Dispatch (http://bit.ly/KVNB9I ) he wants to be sure the right decision is made because someone's life is at stake.  Yeah well his wife's and brother in law's lives aren't at stake anymore are they judge?

If I were on DR, I would tell everyone within earshot that the FBI, CIA, White House, KGB, Interpol, Bankers, Aliens, dead people, healthy people, cats and dogs, not to mention the good people on off2dr : ) were orchestrating the execution.  Get real.  DR offenders will say anything to save their skin.

You know, in HIS counrty it is probably perfectly legal to do what he did to his wife and BIL.  However, when they start coming to other countries, they have to learn and abide by the laws of THAT country.

This is what I find so offensive about these types of people.  They come here for their betterment but can not wrap their heads around our laws.  (was his turban too tight?)

If their countries are so damn good and they want to do everything like it was done in the "old country" here, why in the hell don't they just f**king stay there? 

p.s.  He should be executed just for having that name!  So many of our own forefathers came to this country and had their names changed right at Ellis Island in order to be admitted to this country.  Should have told him his new name was going to be Ben Bacon.
