this is a case that is going on right now. she has not even been arrested because the damn DA gave her time. and she ran to Nigeria. (she was born here but has family there. They talked about it while the fire was being put out, :o)
the thing I want to know is with three dead (burned alive babies) how in the hell do you NOT arrest someone that day. ???
Politics = pile of tricks. Note this is the SECOND TIME our new DA Pat Lykos has not arrested on the spot and the person fled.  >:(both are high profiles due to multiple deaths at once. I just really hope that Tata burns in hell after she is burned alive for doing this to these children. :( >:( :D :'( :'( :'(

the last one shows she had an arson case as a teen.

basically she lied on the application for her child care license and got it along with funds for watching babies.
as the story goes she left.....alone.....7babies under 3 so she could go shopping.
There was grease on the stove that was on (either she left it on or a kid turned it one. They were left alone for 30 plus minutes)
three dead on the scene, that is arson and murder. Not one freaking charge of even manslaughter until Lykos found out thats how she has to be charge to be brought back.
I am beyond pissed. And I'm not a Mother.(yet) I think this bitch deserves the needle. pure and simple she burned these babies alive. >:( >:( >:( >:( >:(

I hate to bring this to anyone's attention but the great state of Texas drags its feet when dealing with female death row convicts!  Bringing this woman back to Texas would probably mean a too short prison term.  Leave the bitch where she is and let her never feel she can safely return to Texas.  And let us morn to poor innocents who she "cared" for!..

Texas may drag its feet with female DR inmates but we do the job after a certain amount of time. Ask Karla, and Betty!. This girl was 22, with 7 children by herself. lied on the application... why let her be free even in Nigeria with fear. take her freedom, and let her have fear inside. The difference is Female DR is handled differently then male. why? Because the males have caused more problems. They were handled the same but of course these saints started messing with...but also juries are hesitated to execute a female unless its Heinous (which this is) . Said it before and I wil say it again anyone, I mean ANYONE that harms a little defenseless baby deserves to be juiced twice.

HOUSTON - Did Jessica Tata knowingly and intentionally leave 4 children to die in a west Houston fire?

It's one question prosecutors will have to answer if they're hoping convict Tata with 4 counts of Murder.

Court records revealed these latest charges Wednesday night. Tata already faces a multitude of other charges in connection to that fatal February fire, including another federal charge related to her flight to Nigeria.

She pleaded not guilty to the charges on March 23.

== What Does This Mean? ==

Murder is a malicious, premeditated homicide. As opposed to Manslaughter, Murder carries with it an intent to kill.

That definition certainly casts a darker pall over the events surrounding that February fire .

HFD's investigation had revealed Tata was shopping at a nearby Target when the fire was taking place. When Tata returned to the scene, witnesses told FOX 26 she was greatly upset and in shock at what was happening.

== Could Tata Face the Death Penalty? ==

Four children, ages 18 months to 3 years, died in the fire.

Under the Texas Penal Code (Section 19.03), that's grounds for Capital Murder. Prosecutors could very well pursue a capital punishment (death penalty) for the 22-year-old woman.

But again, that's only if this latest batch of charges are able to hold up in court.

== What About the Lawsuit? ==

The mother of 2 children who were caught in that fire filed a lawsuit against Tata, Tata's parents and the state of Texas for their alleged roles in the fire.

An attorney acting on behalf of Tiffany Dickerson said the parties' gross negligence contributed to the death of 3-year-old Shomari and the injury of 2-year-old Makayla.

It is unclear if the lawsuit can continue to name Jessica if these charges are able to hold up in court. Due to the timing of this latest news, FOX 26 was unable to contact attorney Mike Gallagher for more info.

Prosecutors rest their case against Jessica Tata
With picture of tiny victim in mind, jury now turns attention to defense

Little Elias Castillo's eyes were closed in his autopsy photo. The cherubic 16-month-old who used to smile and say "cheese" for pictures was expressionless as he lay on the coroner's table.

It was one of the last exhibits prosecutors showed jurors Monday as they wrapped up nine days of testimony to build a case against Jessica Tata, a home day care operator accused in the deaths of four toddlers last year.

The 24-year-old faces life in prison if convicted of felony murder. She is accused of leaving seven children alone to go shopping as a pot of oil left on a hot burner set her west Houston day care on fire. Three children survived the fire.

Prosecutors held up the autopsy picture up as the medical examiner testified the toddler had little soot in his lungs. Forensic pathologist Merrill Hines said the child probably suffocated from invisible carbon monoxide before he could breathe in the thick black smoke that kept rescuers out of the house.

Tata is on trial for Elias' death in the Feb. 24, 2011 fire. She could still face trials in the deaths of 3-year-old Shomari Dickerson, 20-month-old Kendyll Stradford and 19-month-old Elizabeth Kajoh.

The last witnesses in the three-week trial were state officials who confirmed the home day care Tata ran was licensed in 2010, but had been cited for infractions, including the lack of a fire extinguisher and a carbon monoxide alarm.

Jurors were sent home early Monday as Tata's defense team huddled to decide if they want to call witnesses, including Tata, on Tuesday or go straight to closing arguments in state District Judge Marc Brown's court.

Her defense team has tried to show that Tata did not intend harm and even tried to save the children trapped in the day care.

Defense attorney Mike DeGeurin is expected to argue that witnesses said Tata darted into the fiery house and pulled two children out. She also broke a window out with her fist to try to get children out.

He may also call experts to testify about electrical problems with the stove that prosecutors have disputed.

Assistant District Attorney Steve Baldassano has called more than 30 witnesses, including family members of the children, arson investigators and fire experts.

He has also shown store receipts and video of Tata at a nearby Target store minutes before neighbors testified they saw her open her front door to find the fire blazing.

Baldassano is expected to say in his closing arguments that if she had not left the children alone there would have been no fire.

The jury began deliberating Monday how to sentence Jessica Tata, a day care operator found guilty of felony murder last week for the death of one of the toddlers at her west Houston facility..

Sixteen-month-old Elias Castillo and three other children died in the Feb. 24, 2011, fire. Prosecutors said a pot of oil that Tata left on a hot burner started the fire after she left the children alone to go shopping. She faces a penalty of five years to life in prison for the conviction.

'Good loving person'

Closing arguments Monday focused on whether Tata had a calling to care for children and simply made a mistake, or if she selfishly and regularly left kids unattended at her day care.

Both the defense and prosecution played a video taken the day of the fire that showed the day care operator interacting with the toddlers.

Tata's lawyer, Mike DeGeurin, spoke softly and stood behind a table throughout his comments. "She didn't have a private, personal life except with those children," DeGeurin said, holding notes in hand. He explained that those children went everywhere with her, including church.

"Same order as yesterday," he said, echoing Tata in the video instructing the children to load into the van.

"This is something that can't be fixed," DeGeurin said, cautioning the jury against thinking "an excessive sentence" would fix the tragedy. He asked them to focus on Tata's compassion, caring for the children and sometimes helping their parents with rides to work.

"She could've gotten them out if she'd been there, which she promised the parents she would do," DeGeurin said. "But she's also a good loving person."

Deaths 'an inevitability'

Assistant Harris County District Attorney Connie Spence walked to the television screen when she played the video clip, all the jurors turning to watch. She would pause the video to talk about each child caught in the fire that day.

She pointed at a little boy who survived the blaze as he jumps on a door gate fallen to the ground.

"He's going to make the warranty for that product work," she said. Some jury members chuckled and smiled, momentarily breaking the trial's somber mood.

Spence focused on evidence that showed Tata had left the children unattended before, saying the woman was putting her desires ahead of the kids' safety.

"February 24 was not an aberration," she said. "It was an inevitability."

Jury sequestered

Tata is only on trial in the death of one toddler, but Spence asked the jury to also consider the others who died: 3-year-old Shomari Leon Dickerson, 20-month-old Kendyll Stradford and 19-month-old Elizabeth Kajoh.

The jury was sequestered after almost five hours of deliberation. They will continue Tuesday morning.

Jury Sentences Woman Convicted In Deadly Texas Daycare Fire

HOUSTON (November 20, 2012)— Jurors in Houston decided on an 80-year prison sentence Tuesday in the punishment phase of the trial of Jessica Tata, 24, who was convicted of murder in a deadly fire in her home daycare center.

Jurors deliberated for 5½ hours Monday and agreed on a sentence after resuming deliberations Tuesday morning.

Tata faced as much as life in prison after she was convicted last week of murder in the death of 16-month-old Elias Castillo, whom she left at home with six other children while she went shopping.

A pan of oil on a stovetop burner fueled the blaze that broke out while she was gone.

A prosecutor told jurors Monday that Tata doomed the children when she left them alone to go shopping before a deadly fire broke out.

Prosecutor Connie Spence asked for a life sentence, saying the families of the children who died or were injured will never be the same.

Defense attorney Mike DeGeurin says Tata is a good person who made a terrible mistake and asked jurors to not be swayed by anger.
