Joseph Murphy to be executed Oct. 18 for killing Ruth Predmore

MARION -- An execution date has been set for a Marion man convicted of killing a 72-year-old woman during a robbery attempt.

The Ohio Supreme Court granted a motion to set the date for the execution of Joseph D. Murphy, on Oct. 18.

He was convicted in 1987 of killing Ruth Predmore.

Murphy, who was 22 when he was convicted, has been on death row for 24 years.

The court also set dates for six other inmates on death row, ending what had been a break in capital punishment scheduling by the state's highest court.

One of those inmates, Brett Hartman, came within about a week of being executed in 2009 before a federal appeals court allowed him to pursue an innocence claim.

The Supreme Court action Tuesday means Ohio now has executions scheduled each month through October.

The dates were set with no comment, but the announcement came two weeks after Ohio switched to a new execution drug after supplies of the previous drug grew scarce.

The state had repeatedly said it had enough of the former drug to carry out next week's execution of triple murderer Frank Spisak but would not comment about its supply after that.

MARION - The only options left for one Marion man on death row are clemency or pardon after the Ohio Supreme Court set the date for his execution Tuesday.

Joseph D. Murphy, 45, who is incarcerated at the Ohio State Penitentiary, is scheduled to die Oct. 18.

He was convicted in 1987 for murdering 73-year-old Ruth E. Predmore in February of that year in her home at 887 Davids St.

Marion County Prosecuting Attorney Brent Yager said his office will work with the Ohio Attorney General's Office in the coming months on potential clemency hearings Murphy will have a right to.

"He can still ask for that, to set aside his death penalty," Yager said.

"I'm fairly sure his appellate abilities have been exhausted, so he'll be looking for clemency or a pardon at this point," he said.

The victim's advocate in the prosecutor's office has kept in touch with Predmore's family over the years, keeping them informed of what's going on in the case.

Yager said he anticipates he will speak with them soon.

A man convicted in Crawford County of three murders had his sentenced commuted by Gov. Ted Strickland in September last year.

Kevin Keith is now serving life in prison for the 1994 slayings.

Murphy, who was 21 at the time of Predmore's murder, lived less than two blocks from her, at 1049 Davids St.

He was found and arrested while packing his bags at a Caledonia home days after her body was found Feb. 2, 1987, according to Marion Star reports.

He was charged with aggravated murder, aggravated burglary, aggravated robbery and extortion, and he was tried and convicted after a weeklong trial that ended Aug. 28, 1987.

During the trial, defense attorneys said Murphy merely meant to scare Predmore from her home by writing her a note that said "No money, no life. Tonight at 8."

They said he intended to rob her, not kill her.

Then prosecuting attorney Jim Slagle argued the murder was planned because Murphy took a knife with him to Predmore's home.

Before he was arrested, he was seen exchanging rolls of pennies for cash at a gas station on Bellefontaine Avenue. The pennies were taken from Predmore's home, where she collected them in multiple jars.

A jury convicted Murphy of all charges after four hours of deliberation.

Defense attorney Bob Wilson then presented testimony from Murphy's family members and other witnesses during two days of the sentencing phase of the trial, when they said he was beaten regularly and isolated during his childhood. Testimony revealed other disturbing details about Murphy's life.

A jury decided to sentence him to death after eight hours of deliberation, and the judge set his first execution date for Jan. 14, 1988.

Twenty-four years later, Murphy has exhausted his appeals. He wrote a letter to the Star in 2009, apologizing for what he did, adding that he wanted everyone in Marion to know he was sorry.

Murphy was the first Marion County defendant to face the death penalty after it was re-enacted in 1981, according to Marion Star archives.

He has been on death row for 24 years. He was 22 years old when he was convicted of Predmore's murder.

The Ohio Supreme Court has announced execution dates for seven condemned killers, ending what had been a break in capital punishment scheduling by the state's highest court.  Four of those inmates are from Hamilton and Butler  Counties.

Clarence Carter is set to die April 12. He was convicted of killing his cellmate, Johnny Allen, in the old jail annex to the Hamilton County Courthouse in 1988.

Daniel Bedford's execution is set for May 17. He was convicted in 1984 for killing his ex-girlfriend, Gwen Toepfert, and her boyfriend, John Smith.

Shawn Hawkins will be executed on June 14. He's been in prison since 1990 for killing Terrance Richard and Diamond Marteen in Hamilton County.

Kenneth Smith is set to be executed on July 19. He was sentenced to death in 1996 for the murder of Lewis and Ruth Ray in Butler County.

The Supreme Court action means Ohio now has executions scheduled each month through October. My reason for supporting the death penalty? A murderer has less of a right to live than his victim and already presents a danger while incarcerated for life. They have nothing to lose when the most they can get is Life in prison without parole.

i'm not that surprised that OH has become the TX of the north, cause they stared later then most states, their fist one wasn't till 1999, a lot of their inmates finshed their appeals at the same time, All thats happened now is the courts have finally started to set the dates for these animals, the same type of boom happened in TX in 1997 after they passed a law limiting state appeals. right now all thats happening in TX is they've cleared most of the backlog thats why their numbers are not has high this year.

In mid-January 1987, [Murphy] told his girlfriend, Brenda Cogar, that he intended to write a note to Mrs. Predmore demanding money, and
threatening her with death if she did not comply.  On January 27, 1987, Mrs. Predmore visited a Lawson's store in her neighborhood near the
intersection of Davids Street and Bellefontaine Avenue.  While at the store, she talked to Janice Colby, a sales clerk, and displayed to her a
note which she had received.  The note stated as follows:

"You don't have no phone. I want your money.  put it in a bag and put it in your yard or i'll kill you tonite.

"No money

"No life

"Tonite at 8:00"

On February 1, 1987, at approximately 7:00 p.m., [Murphy] left his parents' home clad in a blue tee-shirt, blue jeans, tennis shoes, maroon
vest and brown jacket with white fleece lining.  He went to the Sohio gasoline station on the corner of Davids Street and Bellefontaine Avenue
and requested penny wrappers.  A clerk provided used penny wrappers.

At approximately 9:00 p.m., [Murphy] telephoned his mother and informed her that he had found a credit card.

That same evening, between 9:00 p.m. and midnight, Mrs. Predmore was killed by a five-inch knife wound to her neck.  The knife severed the
trachea, the esophagus, and the right and left carotid arteries and jugular veins.


At approximately 10:30 p.m., [Murphy] returned home.  Although his hands and face were covered with blood, he displayed no cuts or bruises
on his body.  There was no blood on his clothing.  He explained that the blood was the result of a fight.  Thereafter, he went to the bedroom of his brother Michael where they counted pennies and placed them in paper rolls.
The next morning, [Murphy] had a black bag of pennies in paper rolls, some of which he offered his mother to purchase cigarettes. 

On February 3, 1987, [Murphy] entered Lawson's store, showed the manager some rolled pennies in a dark bag and asked whether she would exchange the coins for currency.  The manager declined

It is sad to see how many people will fight to defend someone who thinks that the value of human life is worth less than a jar of pennies.
Live your life in such a way that when your feet hit the floor in the morning, Satan shudders and says..."Oh crap...she's awake!!!"

Sure if you are getting the scores of a toddler then it means you can't think for yourself. But that isn't the issue here. As it says in his appeal, 8 different psychologists failed to find him mentally incompetant.

But is a low IQ the same as the capacity to know right from wrong? I am not convinced it is. There is a wide debate about what IQ even measures.

He had the capcity to lie (claiming he was in a fight), threaten (sending the woman a note) and try and cash in the money.

Surely, that shows that he knew what he was doing was a crime, and that it was wrong. Isn't that what the mental competance claim is for?

You are absolutely right.  I know a lot of mentally disabled people from the workshop.  They know it is wrong to steal.  They know it is wrong to hurt others.  They know it is wrong to murder.  They may be low functioning, but they ALL know right from wrong.

To say these people are mentally challenged when they can hold down jobs on their own, write notes and plan murders is just another way to get them off death row.  Just more scumyer dirty tricks.

They give the real mentally challenged a bad rap that these people do NOT DESERVE! >:(

I have had a few workshops with mentally handicapped people.  Most of the time, they are a joy to be around.  They are for the most part, honest and helpful if they understand what you want.  I feel that they are a gentler version of us.  After all, we dont see them trying what Enron did.

You can lead an ass to water and if you fight long and hard, you can make it drink.  But at the end of the day, after all the fighting, it is still an ass.

I agree with you both, my part time job is with autistic-spectum individuals, and the second I tell people this, they often revert to thinking that this instantly = out of control/violent. It depends on the level of the disorder and the individual personality, but the most are no trouble at all 90% of the time (there are one or two who are a handful, but there is no question over it - you certainly would not miss it). It's rubbish tricks like this that makes everyone think that mentally challenged instantly = dangerous.

I find the murder of Mrs. Predmore especially heinous and sad.  This revolting excuse of a human murders an elderly woman who is trying to help others less fortunate by collecting pennies.  An example of bad things happening to good people.  To top it off, the POS wants to play the mentally retarded game defiling those who are truly disabled.  Makes me fricking ill.  Fry the bastard.
