Man charged with killing daughter's boyfriend appears in court

HILLSBORO • A Cedar Hill man charged with second-degree murder for allegedly killing his daughter's boyfriend argued briefly with the victim before shooting him 11 times, according to court testimony Thursday.

Michael Crutchfield, 22, suffered three gunshot wounds to the head, as well as four to the chest and others to the neck and arm on April 11 in House Springs. He was not armed.

David Fugate told Jefferson County detectives that his daughter, 16, told him that Crutchfield assaulted her.

Crutchfield and the teen had been at the home of David Hopewell that evening. Hopewell took the stand at Fugate's preliminary hearing on Thursday.

He testified that Crutchfield and Fugate's daughter had been dating and that Fugate came to his house to pick up the couple on the night of the shooting.

Hopewell also said the couple had bickered that evening and that Crutchfield had ripped a necklace off the girl's neck. He said Crutchfield had wanted to break up with the girl.

Hopewell said he had seen the girl slap and punch Crutchfield, but had never seen Crutchfield hurt the girl.

When Fugate arrived, the girl ran to the side of his pickup and fell to the ground, screaming and crying.

"Mike was trying to get her to go home," said Hopewell, 20.

Hopewell said the two men yelled at each other, but never exchanged blows.

Crutchfield was about seven feet away when Fugate pulled out a gun and shot him, Hopewell said.

"He kept shooting after Mike fell," Hopewell said.

On Thursday, Fugate wore a neck brace to court. He has been jailed since the shooting without bail. His attorney, Art Margulis, said Fugate suffers from many health ailments, including a disk problem in his neck.

Margulis said his client will enter a plea of not guilty when he is arraigned.

Jefferson County man arrested after shooting daughter's boyfriend

KMOV -- A House Springs man is dead after being shot by his girlfriend’s father.
According to authorities, Michael Crutchfield, 22, was found dead Sunday evening after deputies responded to the scene of an apparent shooting.
 
Police say witnesses claim David Fugate, 48, arrived to pick up his daughter Sunday evening when she informed him that Crutchfield, her boyfriend, assaulted her.
 
Authorities say after hearing the news, Fugate and Crutchfield engaged in a verbal altercation. Fugate then allegedly pulled out a semi-automatic handgun from his waistband and shot Crutchfield multiple times.
 
Fugate is currently being held at the Jefferson County Jail with no bond.

Then Collapses after the Shooting

HOUSE SPRINGS (KTVI-FOX2now.com) —
Forty Eight year old David Ray Fugate is now charged with Second Degree Murder and Armed Criminal Action. The events that lead to this homicide, started early Monday morning in House Springs when Fugate got a call from his 16 year old daughter, saying she was abused by her 22 year old boyfriend Michael Crutchfield.

Fugate went to Michael Crutchfield home, were he argued with Crutchfield. Police say Fugate pulled a semi automatic gun, killing Crutchfield. Crutchfield's body was discovered in the roadway of Ruth Drive off Highway M-M, where one witness described what Fugate said just moments before the shooting.

After the shooting, Fugate collapsed and was transported to St. Anthony's Medical Center with what was thought to be a Heart Attack. He was treated an released and is now being held in the Jefferson County jail without bail.

Jury selection under way in Cedar Hill man's murder trial

Fugate, of Cedar Hill, is charged with second degree murder. He allegedly shot Michael Crutchfield 11 times.

Fugate told Jefferson County detectives that his daughter, 16, told him that Crutchfield, 22, had assaulted her.

A friend of the couple testified at Fugate's preliminary hearing in September that the couple had bickered the evening of the shooting and that Crutchfield had ripped a necklace off the neck of Fugate's daughter. He also testified that Crutchfield had wanted to break up with her.

Closing arguments in Jefferson County murder trial to happen Thursday

UPDATE at 3:56 p.m.  After a delay of more than two hours, attorneys announced they would make closing statements at 9 a.m. Thursday. No reason was given for the delay or for the postponement.

What I want to know is why little "miss thang" there isn't under any charges?
IMHO I think that she instigated the entire thing when her boyfriend tried to break up with her, she went crying to daddy that he had hurt her. As a parent I know that if some 20something physically assaulted my teenager I would probably go ballistic too so what was she trying to start? Granted I am not making excuses for the guy, 11 rounds is a bit excessive there and he needs to be held accountable for his crime but he was a father who thought the guy hurt his little girl when it turns out that "daddy's girl" was full of crap and I think is the one who instigated the entire situation.

Jury finds Cedar Hill man guilty of murdering his daughter's boyfriend

I was at the trial.  The prosecutor asked her on the witness stand:

Q:  Did you exaggerate when you told your Dad that Mike hit you?

A:   Yeah, a little.  Giggle...


Q:  Are you glad your boyfriend is dead?

A:  (she wrinkled up her face - tossed her head side to side then responded by shrugging her shoulders)

During closing arguments the Prosecutor says that a stranger who heard the case would have more remorse than what Megan has and even thought it was funny.

The clothing David Fugate was wearing was laid out on the floor during his testimony.  It showed NO blood whatsoever.  That sort of shoots down his theory that Mike jumped him and while he was atop of him he shot him.

After the verdict was reached (took less than 3-hours), victim impact statements were read.

During Fugate's mitigating impact statements from his wife, Jeanne she states that he has been the best husband and father.
Prosecutor grabbed a police report from 2008 and had her verify it was her handwriting.  The Prosecutor then asked her if she called the police on her husband and wrote the statement 'he told her that if he was drunk he would shoot her'.

Jeanne denied it, but there it is in black and white.  Prosecutor asked if he had to go to the hospital that night?  She said, no.  Prosecutor paged through report and said 'Fugate was taken to hospital when police arrived'  adding, that's what he did the night he murdered Michael when the police came then too.

See, after this guy blew Michael's brains out all over the street and the police came, he faked a heart attack and went to the hospital, but they did not keep him.

The formal sentencing is set for June 28. 

I wish they would charge the daughter with something. 

As a matter of fact they have such a wonderful family and they all wore religious crosses during the trial.  After verdict was read, the family began crying, screaming and cussing at people. 

They have another daughter and both are in the juvenile system.

This is a case where the father was angry that he could not control his daughter and they took it out on this young man.

Prosecutor did an excellent job and thanks to the police and crime scene personnel they were able to present a convincing case despite all the lies that were told and the high profile attorneys (3-of them)

I am so glad that the scumbag father was convicted and hope he spends the rest of his life in prison.  I don't know if he got the death penalty or not, but if he did, I hope his justice is quick and the victim's family does not have to spend endless years waiting for the execution of the perpetrator.

Now to the daughter......may she rot in hell with her father for causing the death of this fine young man.   I hope she is charged with inciting the father to violence or something, but I am afraid she will just get away with it all.

It is a shame that her father was only convicted of 2nd degree murder, it is my opinion that since he took the gun over there he already had the intention of killing poor Michael and he should have been convicted of 1st degree murder and fried for this...and she should fry right along side of him. We will have to wait till June 28th to find out the sentence and hope that the court will take all of the heinous nature of this crime into account and really throw the book at him.

During the trial it came out in his recorded conversation with his wife at the jail he kept saying they charged him with 1st degree murder and he kept saying that Missouri has the death penalty.

I guess the prosecutor saw 2nd degree murder as a slam dunk.  Maybe it was for costs purposes.  If they would have tried him for 1st degree murder then there would have been aggravating circumstances.  Amount of wounding 24 wounds (12 entrance and 12 exits).  He also hid the gun in his trucks console under a bunch of papers the crime scene investigator testified.  The witnesses testified that he pulled the gun from his waist band and was aiming over a 115 pound girl (not megan) and shoved her out of the way and fired the gun right next to her head.  That would have been the next aggravating circumstance (firing a weapon and endangering more than one person)

She tore up all the lies they told on the witness stand with factual documents, photos, clothing he wore and testimony from witnesses, medical examiner, his own recorded voice as well as his wifes and detective's testimony.

Hopefully he will not make it out.  I hope someone gives him what he deserves while he's incarcerated.

He could get consecutive sentencing making it a total of 30 years.  Hopefully he will never get out.
