on: January 10, 2013, 04:35:34 PM 4 General Death Penalty / Recidivism - why the Death Penalty Works / Paroled Double Murderer kills his own Mother

VALLEJO, Calif. —Police say a paroled California double murderer has led officers to the body of his 89-year-old mother.

Vallejo investigators say 70-year-old Dennis Stanworth telephoned police just before noon on Wednesday and said he killed his mother at his home.

Stanworth led arriving officers to the body of Nellie Turner Stanworth. Investigators won't say how she was killed.

Lt. Jim O'Connell says in a news release that Stanworth was arrested and booked for investigation of murder at the Solano County Jail.

Stanworth was sentenced to death in 1966 after being convicted of two counts of murder for kidnapping, sexually assaulting and shooting two teenage girls in Contra Costa County.

The sentence was later reduced to a life sentence, and he was paroled and required to register as a sex offender.

Dear Texas,

As a lifelong resident of California, I have seen that you are requesting to secede from the United States.  Bravo!

Prior to leaving I would like to ask a favor of your great state.  Would you please provide the California Department of Justice your "Rules for a Successful Execution" handbook?

Thank you,

on: October 04, 2012, 06:09:51 PM 12 General Crime / Specific Cases / Calif Parole Board recommends parole for Manson follower - Seriously??

LOS ANGELES –  A former Charles Manson follower imprisoned for 40 years in a double murder engineered by Manson won a recommendation of parole Thursday in his 27th appearance before a parole board panel.
Bruce Davis, convicted with Manson and another man in the killings of a musician and a stuntman, was not involved in the infamous Sharon Tate murders in 1969.

The answer to his plea for freedom came on the eve of his 70th birthday. He was a young man of 30 when he was sentenced to life in prison in 1972 in a case that was a postscript to Manson's notorious reign as leader of the murderous communal cult known as the Manson family.

Davis long maintained he was a bystander in the killings of the two men, but in recent years he acknowledged his shared responsibility because he was present.  The hearing was held at the California Men's Colony at San Luis Obispo, where Davis is imprisoned.

His release was opposed by a Los Angeles prosecutor and by a former Manson family member, Barbara Hoyt, as well as Sharon Tate's sister, Debra Tate. The two women attended the hearing, according to The Tribune of San Luis Obispo.

The recommendation is not the last hurdle in Davis' quest for freedom. The parole grant is subject to a 120-day review period by the entire parole board. If it is upheld, Gov. Jerry Brown then has 30 days to review the decision.

Los Angeles County district attorney's spokeswoman Sandi Gibbons said, "We certainly disagree with the board's decision. We will evaluate how we plan to proceed as the matter goes to Gov. Brown."
She noted that District Attorney Steve Cooley helped persuade then-Gov. Arnold Schwarzenegger to stop Davis' prior parole date in 2010.

A parole board determined then that Davis was ready for release, saying he had no recent disciplinary problems and had completed education and self-help programs.  owever, Schwarzenegger reversed the decision, citing the heinous nature of the crimes and saying Davis was still a danger. Gov. Brown has the final say on decisions by the current parole board.

Davis has been in prison since 1972 after being convicted with Manson and another follower, Steve Grogan, in the murders of musician Gary Hinman and stuntman Donald "Shorty" Shea.

Davis had been set for a hearing earlier this year, but he became ill and it was delayed.  "It's time for him to go home," Davis' attorney, Michael Beckman, who has been fighting for years to get his client released, said before the hearing.

Davis became a born-again Christian in prison and ministered to other inmates, married a woman he met through the prison ministry, and has a grown daughter. The couple recently divorced.  Beckman said Davis also earned a master's degree and a doctorate in philosophy of religion.

Beckman said his client is totally rehabilitated and meets state requirements for parole. Los Angeles County Deputy District Attorney Patrick Sequeira opposed his release.

Few followers of the infamous Manson cult have been released from prison. Grogan was freed in 1985 after he led police to Shea's buried body.

Lynette "Squeaky" Fromme was released from federal prison in 2009 after serving time for the attempted assassination of President Gerald Ford.

Manson and two of his followers, Leslie Van Houten and Patricia Krenwinkel, remain in prison for life in the Tate killings. Their co-defendant, Susan Atkins, died of cancer behind bars in 2009. Another of the Tate killers, Charles "Tex" Watson, remains in prison.

I know this dog personally.  He is at all the kid functions where the police, fire and rescue come so everyone can see them.  Really nice dog, very well mannered.  Savanna drove her Pink Hotwheels Mustang (with the officers approval) up and down his back and he paid no attention.

SACRAMENTO—

A police dog was shot, and a suspect who was hiding in a backyard in Sacramento is now dead.

A couple stole a car in Chico and were spotted in Sacramento Friday morning. Cops picked up the chase near 24th and Broadway around 10 a.m., but the couple was driving erratically through the Land Park neighborhood, almost hitting people walking along the sidewalk. The suspects’ car reached 70 mph during the chase.

Cops pulled back, then a short time later found the suspects’ car abandoned near 4th Avenue and Marty Way.

This is a photo of Bodie, the canine officer who was shot Friday morning. He is expected to be ok. (May 18, 2012)

Homes in the area were evacuated and McClatchy High School, California Middle School and Crocker Riverside Elementary were locked down because of the activity. Parents told FOX40 they were anxious about the situation because they had received text messages from their kids who were being kept in classrooms.

The couple ran from cops but were later stopped and the woman was arrested. The man kept running, at which point a police dog, Bodie, started chasing him into a backyard near Robertson Way and Riverside Boulevard.

While in the backyard, the man fired multiple shots at Bodie, hitting him in the face and paw. Officers returned fire, hitting the man multiple times. He died at the scene.

Bodie was rushed to an animal hospital, and underwent multiple surgeries, and is in stable condition at this time. Bodie is a four-year-old German Shepherd, and has been with the Sacramento Police Department for about a year.

The female suspect was brought in for questioning. She and the man have not been identified at this time.

All schools went back to normal class schedule by lunchtime according to school officials.

'Swamp People' star dies on Louisiana river

Mitchell Guist, who rose to national attention as one-half of the grizzled, alligator-hunting Guist Brothers on History's popular reality show, "Swamp People," has died, Louisiana police have confirmed.

According to a statement made by Sheriff Mike Waguespack to WBRZ-TV Baton Rouge, the incident occurred about 9 a.m. Monday. Guist was cruising along the Belle River when he reportedly "fell" in his boat after having suffered what appeared to be a seizure. Attempts at reviving Guist through CPR were unsuccessful.

A representative from The History Channel offered this statement on Guist's passing:

"We are extremely saddened to report that our friend and beloved member of the Swamp People family, Mitchell Guist, has passed away earlier today," the statement reads. "Mitchell passed on the swamp, doing what he loved. We appreciate your respect for the Guist family’s privacy and hope you join us in sending our thoughts and prayers to his brother, Glenn, and the rest of the Guist family."

The fun-loving Guist brothers were among "Swamp People's" most popular subjects and were happy to relate their adventures of alligator hunting, fishing for gar, tracking rabbits or just getting buzzed on beers and sunshine.

on: April 30, 2012, 09:17:20 AM 15 General Crime / Specific Cases / Robert Dewey Cleared of 1994 Rape/Murder

A man who was sentenced to life in prison without the possibility of parole nearly 16 years ago may walk free Monday after being exonerated by a new analysis of DNA evidence.

Robert Dewey, 51, was convicted in Mesa County, Colo. for the 1994 rape and murder of Palisade resident Jacie Taylor. According to the Denver Post, Dewey has maintained his innocence over the years and repeatedly asked the court to order a retesting of the shaky DNA evidence used to convict him.

Taylor, who was just 19 at the time, had been found strangled to death in her apartment bathtub with a dog leash. She had been beaten and sexually assaulted.

Though evidence that was brought up throughout the trial included a handprint, semen and a blood stain, DNA testing at the time raised at least as many questions as clues.

"There was incomplete sampling done and had they done a greater sampling it would have shown the other person, or shown that it wasn't Mr. Dewey's," Dewey's defense attorney Steve Laiche told KJCT. "They never did have Mr. Dewey's DNA."

Blood found on Dewey's shirt was speculated to have come from Taylor, but an expert witness testified during Dewey's trial, it also could have come from approximately 45 percent of the Caucasian population.

Then-Mesa County District Judge Charles Buss, who handed down Dewey's life sentence in 1995, reportedly said, "I am happy to impose it on you."

That was less than five years before Tim Masters was wrongfully imprisoned for the murder of Peggy Hettrick. Masters would spend almost a decade behind bars before his conviction was overturned in 2008 because of DNA evidence. Hettrick's murder remains unsolved.

CBS4 reports that as the new DNA analysis in the Taylor case exonerates Dewey, it also points to another man believed to be a suspect in her death. Douglas Thames, 39, is already serving a life sentence with parole in Canon City for the murder of Susan Doll, who was also raped and strangled.

Dewey is expected to be released after a press conference in Grand Junction.
