One of the inmates scheduled to die this year is Robert Pruett, who was given a new execution date this week. His lethal injection has been set for April 27.

Pruett came within hours of being put to death last April for the 1999 murder of a correctional officer over a dispute about a sack lunch at the McConnell Unit in South Texas. He was granted a reprieve to allow additional DNA evidence to be tested.

Testimony and evidence at trial showed that Pruett was upset that officer Daniel Nagle wrote him up for eating in an unauthorized area. Nagle was found stabbed to death in his office. The disciplinary reports was found torn up by the body.

Texas death row inmate convicted of killing prison guard wins reprieve

 HUNTSVILLE, Texas (AP) - A Texas death row inmate who faced execution later this month for the murder of a corrections officer won a reprieve Thursday.

 The Texas Court of Criminal Appeals ruling halted the scheduled Aug. 23 execution of Robert Pruett, 36, who was sentenced to death for the December 1999 stabbing death of corrections officer Daniel Nagle, 37, at the McConnell Prison Unit near Beeville.

 Pruett, who maintains his innocence, says his name was on the note found because the guard wrote him up for taking his lunch out into the yard.

 Pruett's lawyers are appealing a ruling from the Bee County trial court that rejected arguments Pruett wouldn't have been convicted if results of DNA testing now available had been known at the time of his trial in 2002.

 The appeals court set no timetable in its ruling Thursday and offered no further explanation.

HUNTSVILLE, Texas (AP) -- A 37-year-old prisoner on Texas death row for the slaying of a corrections officer has received an execution date for later this year.

Texas Department of Criminal Justice spokesman Jason Clark says the agency has received court documents setting Robert Pruett for lethal injection Oct. 12.

Pruett was set to die last August but the Texas Court of Criminal Appeals halted the punishment after Pruett's lawyers appealed a trial court ruling on new DNA testing in his case. In April, the appeals court ruled the trial outcome wouldn't have changed if new DNA test results had been available.

Pruett already was serving a 99-year murder sentence from Harris County when he was condemned for fatally stabbing corrections officer Daniel Nagle in December 1999 at the McConnell Unit prison near Beeville.

The motion for authorization to file a successive habeas corpus petition is DENIED. Pruett's motion for a stay of execution is also DENIED.

I think Texas will finally get to nail this guy.  8)

Execution set for man who killed corrections officer
 
BEEVILLE (KIII NEWS) - Robert Lynn Pruett is set to be executed for the killing of a corrections officer at the McConnell Prison Unit in Beeville.

Pruett is scheduled for execution at 6 p.m. Thursday. He was convicted back in 1999 for the stabbing and killing of Officer Daniel Nagle. At the time, Pruett was 20 years old serving a life sentence in the McConnell Prison Unit for a murder he committed in 1995 in Harris County.

In August of last year, Pruett was granted a stay of execution.

HUNTSVILLE, Texas (AP) -- The Latest on Texas Execution (all times local):

10:30 a.m.

The Texas Board of Pardons and Paroles has rejected a clemency petition from death row inmate Robert Pruett.

Pruett is scheduled to die Thursday evening for the 1999 killing of a Texas corrections officer, Daniel Nagle.

Attorneys for the 38-year-old inmate asked the board to recommend to Gov. Greg Abbott that Pruett be given a 120-day reprieve and that his death sentence be commuted to life in prison.

Parole board spokesman Raymond Estrada says the six-member panel unanimously voted Wednesday not to recommend clemency.

A Texas inmate convicted in the death of a prison guard was put to death Thursday after the U.S. Supreme Court rejected his lawyer's attempts to halt the execution.

Robert Pruett was given a lethal injection for the December 1999 death of corrections officer Daniel Nagle at a prison southeast of San Antonio. Nagle was repeatedly stabbed with a tape-wrapped metal rod, though an autopsy showed he died from a heart attack that the assault caused.

Prosecutors have said the attack stemmed from a dispute over a peanut butter sandwich that Pruett wanted to take into a recreation yard against prison rules.

The 38-year-old Pruett, who was already serving a 99-year sentence for a neighbor's killing near Houston when he was convicted in Nagle's death, lost two appeals at the Supreme Court as his execution neared. He became the 20th prisoner put to death this year in the U.S. and the sixth in Texas, which carries out the death penalty more than any other state. Texas executed seven inmates last year.

Pruett's lawyers had asked the high court to review whether lower courts properly denied a federal civil rights lawsuit that sought additional DNA testing in his case. They also questioned whether a prisoner like Pruett, who claimed actual innocence in federal court because of newly discovered evidence after exhausting all other appeals, could be put to death.

Pruett avoided execution in April 2015, hours before he could have been taken to the death chamber, when a state judge halted his punishment so additional DNA testing could be conducted on the rod used to stab the 37-year-old Nagle. The new tests showed no DNA on the tape but uncovered DNA on the rod from an unknown female who authorities said likely handled the shank during the appeals process after the original tests in 2002.

Pruett's attorneys unsuccessfully sought more DNA testing and filed a federal civil rights lawsuit arguing Pruett had been denied due process. The 5th U.S. Circuit Court of Appeals rejected the lawsuit last week, and the lawyers appealed to the Supreme Court on Tuesday.

Attorneys for Texas told the Supreme Court that Pruett's appeals were delay tactics after issues were "repeatedly raised" and "properly rejected" by the courts.

No physical evidence tied Pruett to Nagle's death at the Texas Department of Criminal Justice's McConnell Unit near Beeville. At his 2002 trial, prisoners testified that they saw Pruett attack Nagle or heard him talk about wanting to kill the guard. According to some of the testimony, he talked about possessing a weapon as well.

Pruett had said he was framed and that Nagle could have been killed by other inmates or corrupt officers at the McConnell Unit.

Pruett's 99-year murder sentence was for participating with his father and a brother in the 1995 stabbing death of a 29-year-old neighbor, Raymond Yarbrough, at the man's trailer home in Channelview, just east of Houston. Pruett was 15 when the attack happened.

According to court testimony from a sheriff's detective, Pruett argued with Yarbrough and then got his father and brother to join him in attacking the man. Pruett punched and kicked Yarbrough and held him down while his father stabbed the man multiple times, the detective said.

Pruett's father, Howard Pruett, is serving life in prison. His brother, Howard Pruett Jr., was sentenced to 40 years.

Took long enough ,but, in the end Pruett got his gurney ride......

Last words and such...

In his final statement before being put to death, the 38-year-old Pruett said he hurt a lot of people and a lot of people hurt him. He said he was sorry and held no grudges.

"I've had to learn lessons in life the hard way," he said. "One day there won't be a need to hurt people."

He told his friends who were watching the execution through a window that he loved them. "I'm ready to go," Pruett said. "Nighty night, everybody. I'm done, warden."

As the lethal dose of the powerful sedative pentobarbital began to flow, he started to chant: "Love. Light. It's forever."  His voice rose as he repeated the phrase. He added obscenities and soon was yelling. He started to slur his words before slipping into unconsciousness.

His last meal was a chicken patty, mashed potatoes, country gravy, black-eyed peas, corn and chili.

Factoids...

Pruett was the 6th condemned murderer executed in Texas this year and the 544th since executions resumed.
His was the 20th 2017 US execution and the 1462nd since 1976.

The skinny...

Pruett slipped through the hangman's noose three times in the past 5 years.  The 4th time turned out to be the charm and Texas lit him up at 6:46 PM CDT.

Anthony Allen Shore is set to be executed in Texas on October 18.  Between 1986 and 1995, Shore kidnapped a 15-year-old girl and strangled her to death with a cord, kidnapped a 21-year-old woman, sexually assaulted her and strangled her to death with a cord, entered the home of a 14-year-old girl, bound and sexually assaulted her, and strangled her to death, kidnapped and sexually assaulted a nine-year-old girl causing her death and kidnapped a 16-year-old girl and sexually assaulted her causing her death.

This asshole is a real poster child for the death penalty...and I hope it hurts like a bastard.
