David Anthony again sent to Arizona's death row in murder of Peoria family

A Maricopa County Superior Court jury on Thursday sent David Lamar Anthony back to death row for the 2001 murders of his wife and her two children.

The jury came back with three separate death sentences for the slayings of Donna Anthony, 54, and her children, Danielle, 14, and Richard Romero, 12.

Anthony, 64, was found guilty Aug. 28 of three counts of first-degree murder, and the jury then found aggravating factors that qualified him for the death penalty. The jurors heard final arguments Wednesday as to whether Anthony should die by lethal injection or be sentenced to life in prison. They came back with the death verdict shortly after 11 a.m. Thursday.

Donna Anthony and the children disappeared on their way from their Peoria home to a family vacation in Ohio.

David Anthony was first convicted in 2002 and was sentenced to death in 2004, even though the bodies had not yet been found.

They turned up in 2005, unearthed in Buckeye where workers were transplanting native trees to make way for a Walmart store.

The bodies had been placed in metal drums filled with acid and then buried.

Anthony's conviction was overturned on appeal in 2008, when the Arizona Supreme Court ruled that the prosecution had overstated its evidence that Anthony had killed the family to cover up sexual abuse of his stepdaughter.

He went back to trial in June of this year, and this time, prosecutors argued that Anthony had killed his wife to keep her money because she wanted to divorce him.

Unlike in the first trial, Anthony's defense was allowed to use a "third-party defense" in which attorney Billy Little argued that one of Donna Anthony's ex-husbands, the father of Danielle and Richard, had in fact committed the murders. The jury did not believe him.

Anthony, whose health has been failing in recent years, attended the latest trial in a wheelchair.
