Victims:Steven Moss and his children Bryan and Kristin

The Crime: Rhode and his co-perpetrator, Daniel Lucas, burglarized the home of Steven and Gerri Ann Moss on April 23, 1998, fled the scene when Rhode discovered an alarm system, and returned later that day to burglarize the home again. While Rhode and Lucas were ransacking the home searching for valuables, 11- year-old Bryan Moss arrived, observed Rhode and Lucas through a front window, and entered through a back door, armed with a baseball bat. Rhode and Lucas subdued Bryan at gunpoint, sat him in a chair, and began discussing what to do with him. Lucas turned and fired at the boy, inflicting a non-fatal shoulder wound. As [Bryan’s sister] Kristin Moss was approaching the house, Lucas took Bryan into a back bedroom. Rhode met Kristin as she arrived, sat her in a chair, and shot her twice with a .357 caliber pistol. Lucas repeatedly shot Bryan with a .25 caliber pistol. Rhode later shot Steven Moss with the .357 caliber pistol when Steven arrived. Finally, Lucas obtained a .22 caliber pistol from Rhode’s automobile and shot Bryan and Kristin again.

News: Brandon Joseph Rhode was executed by the state of Georgia for a 1998 Jones County triple murder.

A spokesperson with the Department of Corrections told 13WMAZ that Rhode was pronounced dead at 10:16 p.m.

Rhode declined both a last statement and a prayer by a clergyman.

Susan Phillips, a spokeswoman with the state Department of Corrections, told us around 9:20 that the execution process had started at 9:14 p.m.

According to the Associated Press, the U.S. Supreme Court denied a stay of execution for Rhode around 8 p.m.

The execution process begins when the warden reads the order of execution. Everyone must be seated in the chamber at that time. The Warden will read the order of execution, then check to make sure there is no "stay." Afterwards, Rhode will be given two minutes to speak; can opt to receive a prayer by a clergyman and then he will receive the lethal injection drugs, said Chapman. The lethal injection drugs typically take several minutes to take effect.

A state board late Monday afternoon issued two more rulings against convicted triple murder Brandon Joseph Rhode.

The execution process was originally scheduled to begin at 7 p.m.

The State Board of Pardons and Paroles denied his attorney's request for a stay of execution and a second application for clemency, according to a news release.

That came a few hours after the state's Supreme Court denied a third stay of execution for Rhode.

The state's highest court also rejected two separate request by Rhode's lawyer to appeal the case again.

As authorities try for the third time in a week to execute Rhode, his lawyer argues that he is "no longer competent to be executed."

Brandon Joseph Rhode's attorney said "the threat of execution has pushed Mr. Rhode's limited coping skills to the breaking point" in a court filing Monday to the Georgia Supreme Court.

The 31-year-old was convicted in 2000 of killing a father and two children during a burglary in their Jones County home.

Rhode slashed his throat and arms hours before his Tuesday execution date, requiring hospitalization. The execution was then pushed back to Friday night amid ongoing appeals, but the state court postponed it again until Monday night.
