Victims: Gerardo Garcia,

The Crime: On 08/17/97, while confined in El Paso, Texas, the subject and 2 other inmates were cooking heroin. The subject made a triple dose of heroin and injected it into the victim, a 22-year old Hispanic male. The victim died of an overdose of heroin. The victim was found when officers did a count in the cellblock.

On August 19, 1997, Garcia was found dead in the bed of his jail cell. An autopsy revealed that Garcia died of a heroin overdose, one so high that it was three times greater than the amount sufficient to cause death. There were fresh needle marks and bruises on his left arm, but no needle track marks, indicating that Garcia probably was not a heroin addict. Prison witnesses revealed that Ortiz had obtained heroin the evening before Garcia was found dead and, that night, had injected
Garcia with the syringe. Ortiz’s cellmate revealed that Ortiz had told him that Garcia “must die” for implicating him in the bank robberies that he and Garcia had committed together. Ortiz was indicted by a Texas grand jury with “intentionally caus[ing] the death of an individual, namely, Gerardo Garcia, by injecting Gerardo Garcia with heroin . . . then and there in the course of committing and attempting to commit the offense of retaliation against Gerardo Garcia.” The retaliation component elevated Garcia’s murder to a capital offense.

News: The state of Texas has executed a high-ranking prison gang member who was convicted of fatally injecting a fellow prisoner with an overdose of heroin.

Forty-six-year-old Ricardo Ortiz was pronounced dead Thursday at 6:18 p.m.

Ortiz was the second killer executed in Texas in as many nights, and the fifth this year in the nation's most active death penalty state.

Ortiz's violent history included an attack on an inmate with a homemade spear. He was sentenced to die for the slaying of 22-year-old Gerardo Garcia, who was killed at the El Paso County jail more than 11 years ago.

Authorities say the slaying was to prevent Garcia from testifying against Ortiz about bank robberies the pair were suspected of carrying out.
